On November 14, 1991, the Park and Recreation Commission reviewed the plat of Wood Pond <br />Hills for trail corridor alignment. The recommendation was that the developer should provide a 35 <br />foot wide trail corridor, and that 15 feet of the 35 foot width must be above the ordinary high water <br />mark (858.1'), The Commission also determined that the developer would receive park dedication <br />credit for only the amount of land given for trail purposes; the balance of park dedication due <br />would be satisified with cash. <br /> <br />On December 3, 1991, the City received a revised grading and drainage plan from the developer <br />which realigned Sunfish Lake Drive in accordance with the City Engineer's letter to DNR dated <br />November 12, 1991. The grading and drainage plan also indicated a trail corridor in accordance <br />with the November 14 recommendation of the Park and Recreation Commission. <br /> <br />On December 3, 1991, the Planning and Zoning Commission reviewed the revised grading and <br />drainage plan received on December 3 and recommended preliminary plat approval of Wood Pond <br />Hills contingent upon the preliminary plat also being amended to reflect the proposed trail corridor <br />and realignment of Sunfish Lake Drive. At that meeting, City Staff recommended that the section <br />of trail in the northwest comer of the plat be provided for in the road right-of-way versus a strip of <br />land running parallel to Sunfish Lake Drive. <br /> <br />The City received a letter from Tom Hovey, DNR, dated December 6, 1991. The letter was in <br />response to the City Engineer's November 12, 1991 letter. Tom Hovey indicates that there is <br />concurrence with the proposed realignment of Sunfish Lake Drive and that additional studies and <br />data will be necessary to rule on the public need for the extension of that street. <br /> <br />On December 17, 1991, the City Council granted preliminary plat approval to Wood Pond Hills. <br /> <br />At this time, the developer is requesting final plat approval of Phase I of Wood Pond Hills. Phase <br />I consists of 32 lots. All lots in the plat meet the minimum area and width requirements. Sunfish <br />Lake Drive will be constructed as an MSA road and the developer wilt participate in the funding of <br />that construction to the extent of a typical residential street. With regard to park dedication, the <br />required land conveyance for trail for the entire plat will be dedicated with Phase I; the cash <br />payment will be only for the number of lots within Phase I. Up until this point, the City has been <br />requiring a cash deposit from developers for the future installation of street lights. Commencing <br />with this plat, City Staff is proposing that there still be cash deposit for the installation of lights, <br />but that the installation will occur along with the installation of other private utilities within the plat. <br />In addition, the City will collect a cash deposit from the developer to cover the cost of operation <br />and maintenance of the street lights for the first 3 years. Following that, the sewer and water utility <br />billings to residents in the plat will include street light maintenance and operation costs. <br /> <br />Recommendation: <br /> <br />City Staff recommends granting final plat approval of Wood Pond Hills contingent upon submittal <br />of a modified grading plan indicating sediment control and house pad elevations and that the plat <br />not be released for recording until there is an executed development agreement between the City <br />and the developer. <br /> <br />Council Action: <br /> <br />Motion to: <br />Adopt Resolution ~t93-03-__ granting final plat approval to Wood Pond Hills and that the <br />plat not be released for recording until the developer provides a modified grading plan and <br />enters into a development agreement with the City. <br /> <br />Review Checklist: <br />CC: 3/24/92 <br /> <br />City Eng~n..eer <br />Zoning Administrator <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br /> <br />! <br /> <br />I <br /> <br />I <br /> <br /> <br />
