That .Mr. Jltmcs Paulzinc, hereinafter referred to as the "Applicant", has properly applied for a~¢~ndi~ional use permit to maintain tWo (2) horses on a parcel measuring less than three 2. That ~e Applicant appeared before the Horse Care Commission on February 18, 1992 and that C~}~ssion has recommended that the City of Ramsey approve the application to maintain t'd,o horses on less than 3 acres. 3. That ~e A~plicant appeared before the Planning and Zoning Commission for a public he .a~, ~ ;.p.~suant to Section 9.03.04 of the Ramsey C. ity Code on March 2, 1992 and that said p(foli¢~earing was properly advertised and that me minutes of said public hearing are her¢l~Y~in¢?porated by reference. 4. That me su~bject property is generally known as 16350 Alpaca Street N.W. and is legally des¢fii:~e,,d a~ follows: Lot[4, Block 2, The North Forty, Anoka County, Minnesota 5. That ~ sUbject.~ parcel is approximately 2.04 acres in size. 6. That tl~ sUl~ject parcel is zoned R-1 Rural Residential. 7. That ~ stu~r~ ounding parcels are also zoned R-1 Rural Residential. 7. That $~fioh 5.09.05 of the Ramsey City Code states that a maximum of 2 horses may be maintained! on a parcel ranging in size from 1.5 acres to less than 3.0 acres with a conditional ~se permit. 8. That l$~:gcfi0n 5.09.04 of the Ramsey City Code states that no stable or barn that houses horsel; ~ay ~ located within 50 feet of a place of human habitation. 9. That 8~tic~ 9.20.11 of the Ramsey City Code states that no buildings housing animals may. be~(wi .Ll~n 75 feet of neighboring property lines. 10. That th~ Applicant has submitted a site plan which indicates that there is a temporary nm-in shed ~t i~ located more than 50 feet from the place of human habitation on the same proPert~ bui~ within 75 feet of neighboring property lines. 11. That ~ A~plicani has stated that if the conditional use permit is granted, a permanent strUctUre tO house the horses will be constructed in accordance with City Code requi nents. 12. That th~ sit6 plan submitted also indicates that there is 1.5 acres of fenced roaming area for the tWo!hoi'~es on the subject property.
