7.61.05'. Cpnditions <br />The coBd$¢t ~! lawful charitable gambling under license issued by the Board shall be subject to the <br />following~con~iitions in the City of Ramsey: <br /> ~ A copy of any lease agreement between a non-profit organization and a gambling <br /> i location owner or operator shall be filed with the City Administrator together with <br /> I the gambling license application; <br /> <br /> i The City Council may refuse to issue a charitable gambling license for a location in <br /> i ,which gambling violations have previously occurred, and the Council may refuse to <br /> ~ssue a charitable gambling license to a non-profit organization which has <br /> ipreviously violated terms of this Ordinance and/or Minnesota Statutes, Chapter <br /> 1349. <br /> <br /> ~,The maximum number of separate gambling locations that any one licensed <br /> !organization shall be permitted to operate within the City is three (3). <br /> <br />7.6 1..06 i~ In!vestigation <br /> <br />Every org~ nizhtion which files an application for issuance or renewal of a charitable gambling <br />license S~ill deliver the application to the City Administrator. The City Administrator shall <br />investigat~ eaC~h application and report any findings and recommendations to the City Council· <br /> <br />7.61.07 Pi!lng of Records; Inspections; Access to Records <br /> <br />Subd. 1 Every organization licensed to conduct charitable gambling in the City of Ramsey shall <br /> ill{with the City Administrator copies of all records and reports required to be filed <br /> v~i~h the Board pursuant to Minnesota Statutes, Chapter 349 and the rules and <br /> r regulations promulgated thereunder. The records and reports shall be filed in the <br /> off, ice of the City Administrator to the Board on or before the da), they are required to <br /> ~ be ~'tled with the Board; <br /> Every gambling event in the City of Ramsey conducted by an organization under <br />Subd. <br /> 2. <br /> i Mi~mesota Statutes, Chapter 349 shall be open to inspection by officers of the Ramsey <br /> ~ ~ P0pce Department; <br />Subd. 3. ~ The City Administrator or employees of the Police Department, at the direction of the <br /> CiD' Administrator, may inspect at any reasonable time, without notice or search <br /> warrant, ail records of a licensed organization, including gambling account and other <br /> bank records required by the Board to be maintained and preserved. <br /> <br />7.61.08 Fee <br /> <br />The City ~ ill~dharge all new applicants the maximum investigation fee permitted by Minnesota <br />Statutes, :~'lapt~r 349 in order to cover costs incurred investigating the application. Any unused <br />portion 6f i:hiS fee will be refunded to the applicant. This fee does not apply to applications for <br />renewal of liicefises. <br />7.61.09 ~USe Of C. haritable Gambling New Profits <br /> <br />Any liccn.sled Organization conducting lawful gambling within the City shall be required to <br />contribute '~n p~rcent (10%) of its net profits derived from lawful gambling to a fund administered <br />and regulai~l.b;y the City without cost to such fund. Disbursements from this fund shall be for <br />lawful p~r~oseis as determined from time to time by City Council resolution· The term "net <br />profitS" as bsextlherein shall be that definition assigned to it by Minnesota Statutes, Chapter 349. <br />This subseqnon ,,shall apply to all licensed organizations conducting lawful gambling with the City. <br /> Page 2 of 3 <br /> <br /> <br />
