Norris <br /> <br />IN RE: <br /> <br />Root Business <br />Conditional Use Permit <br />Our File No. B-4045 <br /> <br />oear Ms. ~orris: <br /> <br /> Thank you for providing us with copies of the pertinent <br />sections of the zoning ordinances, together with a copy of Mr. <br />Root's Conditional Use Permit Agreement. <br /> <br /> There was no mention about parking lot surfacing in his <br />Conditional Use Permit Agreement, which was quite explicit <br />otherwise. Moreover, neither the zoning ordinance in effect at <br />the time he obtained his Conditional Use Permit on May 27, <br />1986, or the new zoning ordinance, effective August 25, 1986, <br />require blacktop or concrete. It, therefore, seems that the <br />City is going beyond the original Conditional Use Permit, and <br />also going beyond the requirements of its zoning ordinance. <br /> <br /> We wonder why this should be necessary. There has been <br />no problem with dust. Mr. Root is struggling to establish a <br />business, and he has been doing his best to comply with all of <br />the requests of the City of Ramsey. It is our understanding <br />that the City does not in any way object to his business <br />operations at this ~oint, and that it is a matter of simply <br />the specif~ <br /> kc surface of his parking lot. This was first <br />brought up ~ul~e recently azser we thought everv~hing had <br />been resolved ro ~he satisfaction of the City. l',~. is a ne~,~ <br />~qu~.~e .... <br /> <br /> Presumably the zoning ordinance is meaningful in stating <br />~ha~ the parking area can be a ':durable and dustless surface," <br />which we understand can be other than blacktop or concrete, if <br />so, what can it be then? (If it could not be anything other <br />than blacktop or concrete, we would expect that it would <br />specify "blacktop or concrete.") <br /> <br /> Has it been determined that the "trap" rock surfacing <br />that Mr. Root applied would not be satisfactory under any <br />circumstances? if the "trap" rock would not create a dustless <br />surface then what would, other than asphalt or concrete? <br /> <br />I <br /> <br />I <br /> <br /> I <br /> <br /> i <br /> Ii <br /> <br /> ! <br /> <br /> I <br /> I <br /> I <br /> <br /> <br />
