Obviously, "Class 5" would not be a dustlesSl surface, but it seems to us that a decorative stone, rock, oril g~avel type of surfacing would be considered "dust- less." O~he~wise, the ordinance has perverse meaning; and we cannot [b~li~ve that to be true. Then, is not the "trap" rock adaquate? P~rh~ps it is a matter of there not being enough "trap" rock applied; and perhaps what was applied should be graded differeh~ly~ In any event, it certainly appears to us that the City shio~]dI no~ demand Root,i When fit's ordinances do not require that. No City can legistat~ ~n an arbitrary manner so as to require of one individual .~hat is not required of all others in the community. M~. Root is a sole proprietor who has but limited means, a~d. it is not easy for him to pay for parking lot resurfa¢~ng -that seems unnecessary. It is even more difficult for him'ito~ presently find the funds with which to post the bond of ~3 ~00. Why is it necessary for him to do so at this time? Th9 cDnstruction cannot take place until next spring. Is the $'3,~0 considered to be in the nature of a penalty?
