Ylitalo <br />Attorney at Law <br />2472 East Seventh Avenue <br />North St. Paul, MN 55109 <br /> <br />Re: Gerald Root Conditional Use Permit/City of Ramsey <br /> <br />Dear Mr. Ylitalo: <br /> <br /> This letter is in response to your letter dated December 9, <br />1986, addressed to the City of Ramsey relating to the above <br />subject. <br /> <br /> Contrary to your statement that there is no mention of the <br />parking lot surfacing in the conditional use permit, I refer you <br />to the last paragraph of the conditional use permit which states <br />,r . . any violation of any other City ordinances may be cause <br />for immediate revocation of this conditional use permit." It is <br />my opinion that this is explicit language relating to all other <br />conditional use permit requirements, and is a more efficient <br />reference rather than including the entire City Zoning Ordinance <br />in the conditional use permit. <br /> <br /> As you know, the applicable ordinance requirement regarding <br />parking lot surfaces states: <br /> <br />Surfacing or drainage: Off-street parking areas shall be <br />paved with a durable and dustless surface in conformance with <br />City Engineering standards. Such area shall be so graded and <br />drained as to dispose of all surface water accumulation <br />satisfactorily. <br /> <br /> Based on the above-language I fail to see, as you contend <br />that the City is going beyond the original conditional use permit <br />and/or its zoning ordinance. The City Engineer, who sets the <br />City's engineering standards, has stated that the "trap rock" <br />applied by your client is not in accordance with the City's <br />engineering standards for the paving of a parking area with a <br />durable dustless surface. In addition, because of its very <br />nature, "trap rock" does not lend itself to establishing a <br />drainage pattern as required by the City's ordinance above <br />cited. <br /> <br /> I <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
