· i ~ JOINT POWERS AGREEMENT <br /> i ? i FOR <br /> ~ ~ r'~ r rom U UN 'TY R ECR EAT'ON COO R D'NATO R <br /> THIS AGRE~E~E~T, made this day of ,1991, between Independent <br />School D~strict No: ?~8 (lDIstrict), and the undersigned municipalities and townships ("Local <br />Governments"); [ii <br /> WHEREAS,~i;~urS~ant to the authority granted by the Minnesota Joint Powers Act, Section <br />471.59, and all othe~aPl~lic~ble statutes and power, the District and several local governments with <br />the district agreetd i~ooQerate in providing for a joint community recreation coordinator; <br /> NOW THE~P~ O~IE, it is agreed by and between the pa~ies as follows: <br /> 1) JOIN~PO~ERS RECREATION BOARD: The membership of the Joint Powers <br />Recreation Boa'rd~rejffer referred to as "Recreation Board") shall consist of the following: <br /> One memb~r~h~l be appointed by the governing body of each pa~icipating lOcal <br />government. One ~em~er shall be appointed from the School Board of District 728. The Recreation <br /> <br /> a. ; ~ro~ide input into the decision making process. <br /> b. ~ ~Re~ommend policy as it relates to Community Recreation Coordinator. <br /> c, ~ ~Giv~ dire~ion to the overall development of Community Recreation. <br /> The term ~e ~embem and officers shall be for the calendar year. Members shall <br />be eligible for rea~int~ent. The Recreation Board shall elect its own officers, in addition, shall <br />adopt its own ~le$.~nd:~rocedures not inconsistent with the terms of the agreement. <br /> 2) ~~ Each year in conce~ with the budget process the Director of Community <br />Education shall re~end a budget to the Recreation Board. This recommended budget shall be <br />prepared in cons~t~t~o~ with the appropriate administrative officials of each of the governmental units <br /> , : ~:~ .... <br />which are a pa~y t~th~ agreement. The budget shall set fo~h the proposed program of a~wt~es to <br />be provided cna $~o°~ distd~-wide basis, and within each of the pa~icipating municipalities and <br /> ' <br />shall be rev,ewed ;a~nu~lly. <br /> Upon the ~p~ro~iate approval of the budget, each participating municipality wilt transmit 1/12 <br />of the approved a~un{ to the School Distd~ each month. At the end of each fiscal year the <br />Recreation Board~all:~eview the funds expended in the previous year. A~ual expenditures in a <br />previous year Sh~ll~e t~e basis for adjusting a cu~ent year's monthly payments based on an over or <br />under expenditure,~f a~tual expenditures compared to the budget in the pdor year. <br /> At the end o~ each year the Director of Communi~ Education shall prepare a repo~ of <br />activities which wff~ c~ndu~ed in the previous year and submit this repo~ to the Recreation Board <br />and to the padies~ thi'~ Agreement. The annual repo~ shall be in a form such that it can be <br />compared to the ~p°~ed program on which the annual budget has been prepared, realizing that <br />flexibility in the pro~ra~ is necessa~ as long as it is within the budget.
