[vOting No: None. <br /> <br />Case #2: !Rlvenwick Development Agreement <br />City AdministratOr Schroeder requested that Council approve the Rivenwick Development <br />Agreement .M pr~sented with the caveat that City Staff and the Developer can agree on future <br />phases of par~ d~dication. <br />Discussion en~sued regarding construction of MSA streets. <br /> <br />Bill Chapmanl, 365 E. Kellogg, St. Paul, MN - stated that he has been working with Faye Addition <br />since 1989. It mas through the sketch plan stage in October, 1990 and final plat stage in July, <br />1992. He sta~ed'.he objects to the provision which limits the use of MSA funds for this project. <br />He felt there tias been a policy change just this year regarding MSA funds. He asked that the City <br />Attorney revieW Ne ordinances, policies and the Development Agreement. <br />City Adminis~'ato~ Schroeder informed Council that Mr. Chapman is asking for Council approval <br />to do the subdiviS!on and he's asking the City to pay $330,000 in MSA funds for all three stages <br />of Riverdale Drivg N.W. as opposed to the $110,000 that Staff feels is fair. He felt the City <br />doesn't have a, ny;~nterest in contributing that significant subsidy to this project. Mr. Schroeder <br />suggested thai: thei'developer should pay an amount equal to the cost of a standard City street and <br />the City Shoul~ pay the additional costs incurred to construct the street to MSA standards. <br />Motion by CqunCflmember Peterson and seconded by Councitmember Beyer to table approval of <br />the Rivenwicl~ Deyelopment Agreement and directed the City Attorney to review the ordinances, <br />policies and ~teve~opment agreements used by the City in the past as it relates to MSA road <br />construction a~d Clarify these for Mr. Chapman. <br /> <br />Motion carne4;t.
