after the State has inspected and approved the <br />improvements. The State will reimburse the LG in a <br />timely manner. Failure to adhere to the above <br />conditions may cause termination of this agreement. <br /> <br />III. OPERATION OF THE IMPROVEMENTS <br /> The LG shall operate the Improvements in the following <br /> manner: <br /> <br />A.The LG shall comply with all local, state, and <br /> federal laws. Regulations and ordinances which may <br /> apply to the management, operation, and maintenance <br /> of the use of the said premises. <br />B.The Improvements may only be used for fishing, <br /> observation, and other compatible uses. <br />C.The Improvements shall be free and remain open every <br /> day during open water'season at least 16 hours per <br /> day between the hours of 6:00 a.m. and 12:00 midnight <br /> or in conjunction with hours existing and established <br /> by the LG for its park facilities. <br />D.Free and adequate parking in the vicinity will be <br /> provided for the fishing Improvements. In addition, <br /> adequate and designated parking spaces shall be <br /> provided for handicapped persons and senior citizens. <br />E.The State shall reserve the right to inspect the <br /> premises at all times to insure that the LG is in <br /> compliance with the terms of this agreement. <br />F.The LG shall provide police protection in accordance <br /> with the LG's customary practices in providing police <br /> protection in the LG's public park areas. <br />G.The LG shall post a sign which states ( ). The <br /> sign shall be provided by the State. <br />H.The Improvements shall remain the property of the LG <br /> after completion, after final approval by the State, <br /> and after reimbursement of agreed upon costs which <br /> can not exceed the limit of( ). <br />I.The LG shall make a good faith effort to keep the <br /> Improvements in clean sightly order in accordance <br /> with the LG's customary practices for the maintenance <br /> of the public park area. Additionally, the LG shall <br /> provide all necessary routine maintenance and repair. <br /> The State will have no obligations to maintain or <br /> repair the Improvements. Changes to the site need <br /> prior approval of the State. <br /> <br />III. FUNDING <br /> The State shall reimburse the LG for agreed upon <br /> expenditures once the improvements meet the criteria of <br /> a final inspection. The design and engineering cost <br /> shall be the responsibility of the LG. The State will <br /> reimburse up to an agreed upon maximum for the cost of <br /> materials and contract labor required to make the <br /> improvement. <br /> <br /> <br />
