SAMPLE~$~ORE FISHING IMPROVEMENT COOPERATIVE AGREEMENT <br /> THISiA~REEMENT, between the State of Minnesota, acting by <br />and throU~h~ithe Commissioner of the Department of Natural <br />Resources~ h~reinafter referred to as the "State" and a Local <br />Unit of G~v~nment, hereinafter referred to as the "LG". <br /> <br />WHEREAS, ~h9 Commissioner of Natural Resources has the authority, <br />duty, and~r~ponsibility under Minnesota Statutes, 1990, Section <br />97A.141, ~oi~provide the public with free state water access sites <br />on lakes ~n~. rivers where access is inadequate; and <br />WHEREAS, ~d~itionally the Commissioner of Natural Resources has <br />the authoritY, duty, and responsibility under Minnesota Statutes, <br />1990, 97Ak0~, Subdivision 3, to provide the public with fishing <br />p~ers; an~ . <br /> <br />WHEREAS, ~un~ing for this project is approved by the Minnesota <br />LegislatU~ei~991,~ ML Chapter 254, Art.l, Sec.14, Subd.3d, as <br />recommend~d~y the Legislative Commission on Minnesota Resources <br />from the Mihnesota future resources fund. <br /> <br />WHEREAS, the LG is authorized under Minnesota Statutes, 1990, <br />471.59 tO~o~erate recreational facilities; and <br /> <br />WHEREAS, ~h~ LG and the Commissioner have determined that a shore <br />fishing i~p~Ovement, hereinafter referred to as "Improvement" is <br />of high p~i~rity under the state public water access program; and <br /> <br />WHEREAS, plans for such Improvement have been designed by the LG <br />and app~o~e~ by the State. The approved plan is attached hereto <br />as Exhibi~ i'~" and shall be referred to as the Plan; and <br /> <br />WHEREAS, ~he plan will be implemented at ($~¢ ~c~o~) shown in <br />Exhibit B! ah~ is legally described as follows (~¢$¢~p~o~). <br /> <br />NOW THEReFORe, in consideration of the mutual benefits to be <br />derived b~ ~he public bodies hereto and for the benefit of the <br />general p~blic, the parties agree as follows: <br /> <br /> I. D~SIGN <br /> T~e design of the Improvement shall be done by the LG, <br /> in' consultation with the State, to improve the access <br /> t~ the waterbody, and to meet handicapped accessibility <br /> r~uirements. It is understood that the State shall <br /> hmve final approval for any Improvements implemented <br /> f~ which the State provides reimbursement. <br /> <br /> II. INSTALLATION <br /> IDstallation of the Improvements will be the <br /> r~sponsibility of the LG. Reimbursements shall be made <br /> <br /> <br />
