Case #5: Change Order No. 1 and Final Pay Estimate for Project #90-30 <br /> ParaBody Landscaping Improvements. <br /> <br />City Engineer Jankowski summarized Improvement Project g90-30 which included landscaping <br />improvements to the ParaBody site located on Sunfish Lake Boulevard N.W. This project was <br />initiated under Tax Increment Financing in September I990 and completed in May 199t. Upon <br />completion of the work, the prime contractor, Noble Nursery, Inc., was unable to make payment <br />to their subcontractors. For this reason, the retainage was withheld and final payment was not <br />made. Recently, lien waivers have been received from the subcontractor and a check by the City <br />Attorney has shown that there are no liens against the project. The project can now be finaied out. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Hardin to adopt Resolution <br />g92-07-171 authorizing Change Order No. 1 and issuing Payment No. 4 as final payment to Noble <br />Nursery, Inc. for Project g90-30. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Beyer, Hardin, Peterson and <br />Zimmerman. Voting No: None. <br /> <br />Case #6: <br /> <br />Review of Interim Use Permit for Auto Repair/Towing Approved for <br />Issuance to Fred Dinnetz. <br /> <br />Zoning Administrat0~ Frolik discovered that Mr. Fred Dinnetz was no longer associated with <br />A.T.H. The interim use permit was issued to Mr. Fred Dinnetz personally, and it was to expire <br />coincidentally with his relocating the auto repair facility from the subject site or one year, <br />whichever came first. <br /> <br />Greg Isaacson, attorney for Mr. Stanley Browning, stated that Mr. Browning is the sole owner of <br />A.T.H. and that Mr. Dinnetz had only been an employee. Mr. Isaacson cited that the expiration of <br />the interim use permit was contingent upon departure of the business, not Mr. Dinnetz. Mr. <br />Isaacson requested to have the interim use permit reissued in Mr. Browning's name. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Zimmerman to reissue the <br />interim use permit to Mr. Stanley Browning until May 27, 1993 on the condition that Mr. <br />Browning takes with him all items that are his when he moves and will identify, for a City Staff <br />member, those items that are not. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Beyer, Peterson and <br />Zimmerman. Voting No: Councilmember Hardin. <br /> <br />Case #8: <br /> <br />Request for Final Plat Approval of Windemere Woods 2nd Addition; <br />case of Windemere Woods of Ramsey, Allen Koenig. <br /> <br />Zoning Administrator Frolik stated that Allen Koenig has requested final plat approval of <br />Windemere Woods 2nd Addition. The issue of park dedication requirements was resolved with <br />the development of the first phase. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Resolution g92-07-172 granting final plat approval to Windemere Woods 2nd Addition. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Beyer, Hardin, Peterson and <br />Zimmerman. Voting No: None. <br /> <br />City Council/July 14, 1992 <br /> Page 8 of 11 <br /> <br /> <br />
