COMMISSION BUSINESS <br /> <br />Case #1: Request for a Conditional Use Permit to Construct a Metal Accessory <br /> Structure on Less than 2.5 Acres; Case of James Struwve <br /> <br />Zoning Administrator Frolik stated that Mr. James Stmwve is requesting a conditional use permit <br />to construct a metal accessory structure on his property at 15328 Hematite Street N.W. City Code <br />restricts the establishment of metal accessory structures to parcels 2.5 acres and larger is size and <br />the subject property measures 2.2 acres in size. However, the parcel was split by the construction <br />of 153rd Avenue N.W. and prior to that split the property measured approximately 5 acres in size. <br /> <br />The Commission reviewed the proposed findings of fact. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Terry to amend #15 to read <br />"That the proposed use will not adversely impact traffic in the area". <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Holland, Terry, Deemer, <br />Hendriksen and LaDue. Voting No: None. Absent: Commissioner Thomd. <br /> <br />Motion by Commissioner Terry and seconded by Commissioner Holland to amend gl 6 to read <br />"That the proposed use will not be dangerous or detrimental to persons residing or working in the <br />vicinity". <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Terry, Holland, Deemer, <br />Hendriksen and LaDue. Voting No: None. Absent: Commissioner Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to amend #17 to <br />read "That the proposed use will not substantially or adversely impair the use, enjoyment or market <br />value of surrounding properties". <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, <br />Holland, LaDue and Terry. Voting No: None. Absent: Commissioner Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to amend gl 8 to read <br />"That the proposed use will be maintained in order to be harmonious in appearance with the <br />existing and intended character of the R- 1 Rural Residential District". <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Hendriksen, LaDue and Terry. Voting No: None. Absent: Commissioner Thorud. <br /> <br />Motion by Commissioner Terry and seconded by Commissioner Deemer to amend #19 to read <br />"That the proposed use will be adequately served by essential public services". <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Terry, Deemer, Hendriksen, <br />Holland and LaDue. Voting No: None. Absent: Commissioner Thorud. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Terry to amend #20 to read <br />"That the proposed use will not create excessive additional requirements at public cost for public <br />facilities and services. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Holland, Terry, Deemer, <br />Hendriksen and LaDue. Voting No: None.
