The fair market value as determined by the City Council based ' G.~f <br />upon appraisals, accepted purchase agreements, comparable <br />market transactions or other pertinent records as determined by <br />the City Council. <br /> <br />The City 0au,~¢il, upon review and recommendation of the Park and Recreation <br />Commissiofl shall annually determine by resolution the park and dedication fee per <br />residential u~it.!l <br /> <br />If, at the opt~on, lof the City Council it is determined that a cash dedication shall be made, <br /> Recreation and deposited by <br />said cash sh~¢ placed in a special fund for Parks and use <br />the developei' with the City prior to final plat approval. <br /> l~Ubd. 7. Combination of land dedication and cash payment. <br />In appropriate t~!ats, a combination of land and cash may be required by the City Council. <br />In the event ~ e'~mbination of land and cash is required, the amount of land to be dedicated <br />shall be eredit~ against the total park dedication requirement and the remaining cash <br />contribution~sh~! I~e based on the greater of the specified cash contribution per dwelling <br />unit or the fair ,~arket value of the land. When determining the cash contribution for the <br />remaining a~re~/le, the overall density of the plat shall be the basis for determining the <br />potential nu~b~ ~f dwelling units per acre. <br /> ~]ubd. 8. Scenic easements. In appropriate plats, as determined by <br />agreement b~tw~¢n the City Council and the subdivider, the subdivider may dedicate to the <br />public a scc~ic {~ement in combination with the requirements of §9.50.37 Subd. 2 and 3 <br />above or, if the ~ubdivider and City Council agree, the scenic easement dedication may be <br />in lieu of uP[o ~J5% of the requirements in §9.50.37 Subd. 2 and 3 above. <br /> ' ~.Ubd. 9. Required improvements. Subdividers shall be responsible <br />for making ¢~ main improvements to the parkland they dedicate within their development for <br />park, playgrc.untl ~and pubhc open space purposes as follows: <br /> <br /> Provide finish grading and tuff establishment for all park, playground, <br /> trail and public open spaces and provide landscape screening in <br /> accordance with City Policy. <br /> <br /> bi.' Complete, construct and pave trails which are identified in the City's <br /> :: Trail Corridor Plan in accordance with City Standards concurrently <br /> with the roads in their developments (i.e., grading with site grading <br /> ~ and paving with street or parking lot paving). Park dedication credit <br /> ~ will be given for right-of-way connecting these trails to existing or <br /> :. proposed trails identified in the City's Trail Corridor Plan as well as <br /> ' for construction of the wail(s) and associated improvements at a <br /> :rr rate determined by the City Engineer. <br /> <br /> <br />
