33. <br /> <br />CUP,~ rJh~ City may, upon 30 days' written notice to the Permit <br />Hoi~i~ enter into the property and perform all such <br />obli~a~ions, the costs of which shall be borne by the Permit <br />Hold,flor, in default thereof, by its surety. <br /> <br />~Dahcial Assurance. Danny's Aluminum Processing, !nc. shall <br />subm~t~!~inancial assurances as follows: <br /> <br />(a) i~~~_Fees. Danny's Aluminum Processing, Inc. <br /> ~agrees to pay to the City upon the issuance of this CUP <br /> ~.a fee in an amount sufficient to reimburse the City for <br /> !~gineering, legal and administrative expenses reasonably <br /> ~lncurred during the consideration and development of this <br /> !C~P. The Permit Holder shall reimburse the City for all <br /> ia~ministrative fees incurred by the City in connection <br /> ~w£~h inspection of the aluminum processing operation and <br /> administration of this CUP. <br /> <br /> .In the event the City incurs additional reasonable costs <br /> ~o=oasioned solely by the presence of this use within the <br /> Ci=y of Ramsey for personnel training, specialized <br /> ieg~ipment, risk insurance or increased contract costs for <br /> iproviding fire department services, the Permit Holder <br /> ~a~rees to reimburse the City at cost upon presentation <br /> ilof supporting documents and invoices consistent with <br /> /aPplicable law. <br /> <br />(b) ~Lia~i!itv Insurance and Liability Indemnification. The <br /> iP~mit Holder shall secure and maintain insurance from <br /> ah~ insurance company acceptable to the City and <br /> ~aU~horized to write casualty insurance in the State of <br /> i~ir~nesota which will protect the Permit Holder, its <br /> iagents and employees and the City from claims for bodily <br /> ~injury, death or property damage which may arise from the <br /> !oPerations on the Site. The Permit Holder sh=ll file a <br /> ic~ificate of insurance or a ce~ified copy of the <br /> ii~suranoe policy with the City. Such insurance policy <br /> isbell contain a clause providing *.hat it shall not be <br /> i~&~celled by the insurance company ~ithout thirty (30) <br /> idays' %~itten notice to the City of intention to cancel. <br /> The following coverages shall be provided in amounts not <br /> 'leSs than those specified: <br /> <br /> ~i. Public liability, general liability, personal injury <br /> and property damage: <br /> <br />(3) <br /> <br />Injury or death of one person - $1,000,000. <br />Injury to more than one person in a single <br />accident - $1,000,000. <br />Property damage - $1,000,000. <br />Total Aggregate Liabil~y for all items - <br />$I,000,000. <br /> <br />6 <br /> <br /> <br />
