12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />21. <br /> <br />22. <br /> <br />That the;Apphcant has subrrntted rewsed documentauon dated August 26, 1992, <br />dra~n by Hakanson Anderson Associates, Inc. consisting of a four (4) sheet set <br />in¢l/)di~g boundary survey, site plan, grading plan, landscape plan, and a two (2) <br />sh¢~l S~ of signed architectural drawings prepared by Graphic Design, dated <br />Augusi~ 26, 1992, for a proposed structure on Lots 2 and 3, Block 4, Gateway <br />North Ih~dustrial Park Plat//2. <br />That on April 25, 1989, a conditional use permit was issued by the City of Ramsey <br />to: the ~p, plicant for an aluminum processing facility on Lot 1, Block 4, Gateway <br />Nol~lh hdustrial Park Plat #2. <br /> <br />That on November I3, 1990, an amended conditional use permit was issued by the <br />City of!Ramsey to the Applicant to expand capacity at the subject facility by <br />all~xvifig the addition of a second melt furnace to the operation. <br /> <br />That n~ither the original condittonal use permit ~ssued on April 25, t989, nor the <br />amended conditional use permit issued on November 13, 1990 permitted the <br />dis~ssa ,mbly of eng:nes and transm:ss;ons on the subject s;te. <br />Tha~t t~ Applicant is proposing to construct a 13,000 square foot building in which <br />to laroCi~te inside area for the disassembly of engines and transmissions. <br /> i <br />That ia i1991, the City of Ramsey issued a conditional use permit to Alloy Recovery <br />Co~pi~tay which included the disassembly of engines and u-ansmissions within the <br />bUiJCl]lag on the site. <br />Thiat the original conditional use permit issued on April 25, 1989 and the amended <br />co4difi0nal use permit issued on November 13, 1990 prohibited the outside storage <br />of ~1¢ ~bris and materials not used in the aluminum recovery operations, but they did <br />no~ speg. Lfically permit or prohibit the acceptance of other metals on the site. <br />Th~at o~n May 13, 1992, City Staff visited the existing facility on Lot 1, Block 4, <br />G~te~ay North Industrial Park Plat #2 and observed the following: <br /> <br />a),~ Disassembly of engines and transmissions indoors. <br /> ~Outside storage of debris and/or materials not resulting from or used in the <br />b),: <br /> ~ . , aluminum processing operation. <br />c) ~: '. Outside storage on Lots 2, 3 and 4 without providing for screening. <br />Ttiat MPCA Rule 7045.0120 and Anoka County Hazardous Waste Management <br />O~di~ance No. 85-4, 86-3 and 87-1, part 3.02G, states that waste oil to be recycled <br />w~c~ ~s certified in a disclosure by the person producing or accumulating the waste <br />oi~ n~t[to knowingly contain waste listed in MPCA Rule 7045.0135 is exempt from <br />p~tting requirements. <br />T~at,the Applicant has provided Anoka County Environmental Services with the <br />re~ui~exl information for handling waste oil. <br />T~at!Anoka County Hazardous Waste Management Ordinance No. 85-4, 86-3 and <br />-- :--8'~-1~ part 4.00 (Licensing) states that no person shall allow property under his <br />c~nttol to be used for any activity which generates hazardous waste except at a site <br />f6r ~hich a hazardous waste generator license has been granted by the Department. <br /> <br /> <br />
