§ 7.53 SulxL 3. When the license is for a premises where the building is not ready for occupancy, the time fixed for computation of the license fee for the initial license period shall be 90 days after approval of the license by the City Council or upon the date the building is ready for occupancy, whichever date is sooner. Subd. 4. At the time of each original application for a license, the applicant shall pay in full to the City Administrator an investigating fee as required by §7.01.10. No investigating fee shall be refunded. Sub& 5. Where a new application is filed as a result of incorporation by an existing licensee and the ownership, control and interest in the license are unchanged, no additional license fee will be required. 7.53.09 Granting of licenses. The following procedure shall be followed in processing applications for licenses under this section: Subdivision 1. All applications for a license shall be referred to the City's Chief of Police and to such other City departments as the City Council shall deem necessary for verification and investigation of the facts set forth in the application. The chief of police shall cause to be made such investigation of the information requested in §7.53.05 as shall be necessary and shall make a written recommendation and report to the City Council, which shall include a list of ail convictions of violations of federal, state or municipal taw by the applicant. SubcL 2. Upon receipt of the written report and recommendation by the chief of police and at the next regularly scheduled meeting thereafter, the City Council shall instruct the City Adrnlnistrator to cause to be published in the official newspaper, ten days in advance, a notice of a public hearing to be held by the City Council, setting forth the day, time and place when the hearing wilt be held, the name of the applicant, the premises where the business is to be conducted, and such other information as the City Council may direct. Within 45 days after the hearing, the Council may either grant or deny the license. If the license is gr~nted, the Council may withhold its issuance ~nti] the applicant has qualified in ail respects for the license. If the premises to be licensed are not complete at the time that the hearing is conducted, the Council may grant the license, but shall withhold its issuance until the premises have been completed in accordance with the representai~ons made by the applicant. Subd. K The City Administrator shall, within ten days after the issuance of any license under this section, submit to the liquor control cor~missioner the full name and address of each person granted a license, the trade name, the effective license date, and the date of e×~piration of the license. He shall also submit to the liquor control commissioner any change of address, transfer, cancellation, or revocation of any license by the Council during the license period.
