§ 7.53 <br /> <br /> SulxL 3. When the license is for a premises where the building is not <br />ready for occupancy, the time fixed for computation of the license fee for the initial <br />license period shall be 90 days after approval of the license by the City Council or <br />upon the date the building is ready for occupancy, whichever date is sooner. <br /> <br /> Subd. 4. At the time of each original application for a license, the <br />applicant shall pay in full to the City Administrator an investigating fee as <br />required by §7.01.10. No investigating fee shall be refunded. <br /> <br /> Sub& 5. Where a new application is filed as a result of incorporation <br />by an existing licensee and the ownership, control and interest in the license are <br />unchanged, no additional license fee will be required. <br /> <br />7.53.09 Granting of licenses. The following procedure shall be followed in <br />processing applications for licenses under this section: <br /> <br /> Subdivision 1. All applications for a license shall be referred to the <br />City's Chief of Police and to such other City departments as the City Council shall <br />deem necessary for verification and investigation of the facts set forth in the <br />application. The chief of police shall cause to be made such investigation of the <br />information requested in §7.53.05 as shall be necessary and shall make a written <br />recommendation and report to the City Council, which shall include a list of ail <br />convictions of violations of federal, state or municipal taw by the applicant. <br /> <br /> SubcL 2. Upon receipt of the written report and recommendation by <br />the chief of police and at the next regularly scheduled meeting thereafter, the City <br />Council shall instruct the City Adrnlnistrator to cause to be published in the official <br />newspaper, ten days in advance, a notice of a public hearing to be held by the City <br />Council, setting forth the day, time and place when the hearing wilt be held, the <br />name of the applicant, the premises where the business is to be conducted, and <br />such other information as the City Council may direct. Within 45 days after the <br />hearing, the Council may either grant or deny the license. If the license is <br />gr~nted, the Council may withhold its issuance ~nti] the applicant has qualified in <br />ail respects for the license. If the premises to be licensed are not complete at the <br />time that the hearing is conducted, the Council may grant the license, but shall <br />withhold its issuance until the premises have been completed in accordance with <br />the representai~ons made by the applicant. <br /> <br /> Subd. K The City Administrator shall, within ten days after the <br />issuance of any license under this section, submit to the liquor control <br />cor~missioner the full name and address of each person granted a license, the <br />trade name, the effective license date, and the date of e×~piration of the license. He <br />shall also submit to the liquor control commissioner any change of address, <br />transfer, cancellation, or revocation of any license by the Council during the <br />license period. <br /> <br />I <br />I <br />I' <br />I <br /> <br />7.53.10 <br />any person: <br /> <br />Person ineligible for license.
