§ 7.53 <br /> <br />Intoxicating Liquors Off-sale <br /> <br /> Sub&2. Off-sale licenses shall be granted only to premises or <br />buildings which constitute new construction as defined in this subsection. <br /> <br /> Sub&3. No off-sale license shall be granted, or renewed, for <br />operation on any premises on which real property taxes, and special assessments <br />or other financial claims of the City or County of Anoka are delinquent and unpaid. <br />In the event an action has been commenced pursuant to the provisions of Chapter <br />278, Minnesota Statutes, questioning the amount or validity of such taxes, the <br />Council may, on application by the licensee, waive strict compliance with this <br />provision; no waiver may be granted, however, for taxes or any portion thereof <br />which remain unpaid for a period exceeding one year after becoming due. <br /> <br /> Sub& 4. No license shall be granted to a foreign corporation. <br /> <br /> Sub&& No license shall be granted for any place which has a <br />common entrance or exit between any two establishments, except that a public <br />concourse or public lobby shall not be construed as a common entrance or exit. <br /> <br /> Sub&~ No off-sale license shall be granted unless the building <br />proposed to be the licensed premises contains a minimum size of 4,000 square feet <br />of area consisting of public sales display area and/or private storage area, ail of <br />which area must be devoted exclusively to the off-sale liquor business. <br /> <br /> Sub& 7, No off-sale license shall be granted within 1,000 feet of any <br />elementary, secondary, or vocational school or within 1,000 feet of any church. For <br />purposes of this measurement, the distance shall be determined by measuring the <br />distance between the main entrance of the school and church and the main <br />entrance of the licensed business. <br /> <br /> Sub& 8. No off-sale license shall be granted unless the proposed <br />business is located in an area zoned to permit such a land ~se and unless the <br />proposed business is located within the City's urban area, which urban area is as <br />designated on the City's official zoning map. In addition, the premises shall be <br />required to receive site plan approval from the City prior to building construction. <br /> <br /> Sub&9. No off-sale license shall be granted unless the building <br />housing the premises has been constructed in accordance with the State Building <br />Code, Fire Code, and any other relevant building and construction safety <br />requirements of the City of tL~msey, including the installation of security alarms. <br /> <br />7.53.12 Conditions governing license issuance. The following conditions <br />govern issuance of a hcense pursuant to this section: <br /> <br /> Subdivision 1. Every license shall be granted subject to the proxdsions <br />of this section and of any other applicable ordinance or law, including Chapter <br />340A of 1V[~neso~a Statutes. <br /> <br /> Sub&2.
