Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #92-11- A RESOLUTION DECLARING CONDITIONS OF CONDITIONAL USE PERMIT FOR AN OUTSIDE DISPLAY AREA ASSOCIATED WITH A MOTOR VEHICLE SALES LOT WHEREAS, the Ramsey City Council adopted Resolution #92-11- regarding Findings of Fact # for this use and herein approves a Conditional Use Permit subject to the following conditions. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On , 1992 a conditional use permit ("CUP") was issued by the City of Ramsey ("City") to Dalles R.V. World, Inc. ("Permit Holder") to establish an outdoor display/sales area in the B-3 Business District on the property generally known as 7103 Hwy. #10 N.W. and legally described as follows: That part of the Southwest Quarter of the Southwest Quarter, Section 27, Township 32, Range 25 and of the Northwest Quarter of the Northwest Quarter, Section 34, Township 32, Range 25, described as follows: Beginning at a point on the northeasterly right-of-way boundary line of Trunk Highway No. 10, as shown on Minnesota Department Of Transportation Monumentation Plat 02- M5, filed as Anoka County Recorder Document No. 541042, distant 710.23 feet southeasterly from the intersection of said northeasterly highway right-of-way boundary line with the west line of said Southwest Quarter of the Southwest Quarter of Section 27; thence on an assumed bearing of South 65 degrees 22 minutes 49 seconds East, along northeasterly highway right-of-way boundary line, a distance of 33.01 feet; thence on a bearing of North, parallel with the west line of said Southwest quarter of the Southwest Quarter of Section 27 and its southerly extension, a distance of 355.61 feet to the southerly railroad right-of-way line of Burlington Northern Railroad Company; thence North 66 degrees t 1 minutes 34 seconds West, along said railroad right-of-way line, a distance of 143.37 feet; thence on a bearing of South a distance of 205.79 feet; thence South 65 degrees 22 minutes 49 seconds East a distance of 111.28 feet; thence on a bearing of South a distance of 147.58 feet to the point of be~nning. -and- Lot 1, Block 1, Kovar Addition. The west line of the above described land is marked by judicial landmarks set pursuant to Torrens Case No. T-2698. This permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this permit are as follows: This permit shall remain in effect so long as the conditions imposed herein are complied with except that the permit cannot be transferred without the prior expressed approval of the Ramsey City Council. The subject property shall be permitted for an outdoor display/sales area that will accommodate a maximum of forty-four (44) vehicles. No vehicles shall be displayed along the west side of the driveway.
