AND KRIS'TII~WEINMANN'S REQUEST FOR A CONDITIONAL USE PERMIT TO MAtN~I'~I,N ONE HORSE ON A PARCEL LESS THAN 3 ACRES IN SIZE AND CONS~R~i)CT A METAL ACCESSORY STRUCTURE ON A PARCEL LESS :' THAN 2.5 ACRES IN SIZE 1. That J: and; Krisne Wmnmann, hermnafter referred to as t e pp cants , have properly applied fdria conditional use permit to maintain one (1) horse on a parcel measuring less than t~e6~ i3) acres in size and construct a metal accessory structure on a parcel less than two an~ ore-half (2.5) acres in size. 2. That !~e Applicants appeared before the Horse Care Commission on October 21, 1992 and that cfimr~."~ssion has recommended that the City of Ramsey approve/deny the application to maint~n 0rle horse on less than 3 acres. 3. That the Applicant appeared before the Planning and Zoning Commission for a public hearing pCrsuant to Section 9.03.04 of the Ramsey City Code on November 5, 1992 and that sai~. l~Urrblic hearing was properly advertised and that the minutes of said public hearing are hetJeb'2~ incorporated by reference. That t~e SUbject property is generally known as 7903 157th Avenue N.W. and is legally descri ~I~ al; follows: ',L°t3, Block 1, Sorteberg's 2nd Addition, Anoka County, Minnesota That the subject parcel is approximately 2.3 acres in size. That tl-~e subject parcel is zoned R-1 Rur~ Residential. That the surrounding parcels are also zoned R-1 Rural Residential. That :S .~ctio.n 5.09.05 of the Rams% CiL~ Code states that a maximum of - horses may be maintaiinedlon a parcel ranging in size from 1.5 acres to 3.0 acres with a conditional use permit~ 10. 11. 12. That the Ci~ty has previously approved a similar request for horses on less than 3 acres in the Rural Residential District. That Section 5.09.04 of the Ramsey City Code states that no stable or barn that houses horses may be located within 50 feet of a place of human habitation and Section 9.20.11 states fihat: no buildings housing animals may be within 75 feet of neighboring property That thee Applicant has submitted a site plan which indicates that the structure proposed to house the,horse will be at least 50 feet from places of human habitation and 75 feet from property lines. That Section 9.11.02 of the Ramsey City Code states that on parcels less than 2.5 acres in size, the 4CCessory structure shall be built with the same type construction materials and shall have ,the same general design and exterior facing finish as that of the pr/ncipal structure Off the parcel.
