CASE #: 4 <br /> <br />PROPOSE.~:[0~INANCE TO AMEND CITY CODE CHAPTER 9 (ZONING AND <br />SUBDIVi$~Ij2}~Ii OF LAND), SECTIONS 9.(}2, 9,21.23, 9.50.37, 9.50.50, AND <br /> r ~ SECTION 9.50.57 <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background* · <br /> <br />In recent w¢¢k..S Veer have reviewed the need to amend various parts of the Zoning and Subdivision <br />Chapter. The firsi hrea is an amendment to Section 9.02 (Definitions) to eliminate the opportunity <br />to ~nclude roa~l ~ght-of-way when detenmne mxmmum lot area and to include a definmon for <br />parcel The ~e¢6nd is amendments to Sections 9.50.37, 9.50.50 and 9.50.57 to relative <br />subdivision d~ig,fllstandards. The third area is modifying the B-3 Highway Business District to <br />broaden the' p~it!ed uses based on performance standards and eliminate the frequency by which <br />conditional us{ permits would be required. <br />A copy of proPos~ Ordinance 892- is enclosed. <br /> <br />Observations: <br /> <br />The ComrmsS~on ~as reviewed the proposed code amendments on two occasions. One of the <br />issues discussed ~as the fact that with the elimination of conditional use permits for outside <br />display/salos ~ealsland storage areas, the City also would lose the written authority to require a <br />financial guar~nteel for the site improvements and a completion date for the improvements. It was <br />suggested that~the~ proposed B-3 District regulations be revised to require a site plan review for site <br />improvementS: .. <br /> <br />Staff was als~dir~cted to research the possibility of including language in the B-3 Highway <br />Business Distt'ic~{regulations to amortize all nonconforming uses into compliance, relative to <br />required site i~pf0vements, within a specified time frame. Language has been drafted to require <br />all sites in the~B~BiDistrict to be in compliance with the required site improvements (paved and <br />curbed drive'ayah, customer/employee parking and outside display/sales areas) by January 1, <br />1997. Please i-efe-~ to 9.21.23, subd. 4, item #22. I have no basis for this date so it is certainly <br />negotiable and :ail l~he date of this writing, the City Attorney had not issued an opinion on this <br />language.
