incurred by the City for engineering and legal fees and other expenses in connection with <br />the making of such improvements, The performance of said contract shall be financially <br />secured by a cash escrow deposit or financial surety as hereinafter set forth. No <br />performance contract or financial security shall be required for any improvement which is <br />not a requirement for approval of the final plat, The contract shall also provide that the <br />subdivider give a one year warranty and guarantee to the City from date of acceptance by <br />the City on all improvements constructed on behalf of or dedicated to the City. <br /> <br /> Subd. 8. Construction Plans (All Development Areas). <br />Construction plans and specification for the required improvements conforming in all <br />respects with the code and ordinances of the City shall be prepared at the expense of the <br />subdivider by a professional engineer registered by the State of Minnesota. Such plans and <br />specifications shall be approved by the City Engineer and shall become a part of the <br />performance contract. Two prints of said plans and specifications shall be filed with the <br />City Administrator or designated representative. <br /> <br /> Subd.9. Inspection (All Development Areas). All required <br />improvements shall be inspected during the course of construction by the City Engineer and <br />acceptance of said improvements by the City shall require the prior written certification by <br />the City Engineer that said improvements have been constructed in compliance with the <br />plans and specifications. <br /> <br /> Subd. 10. Prior Improvements. Improvements which have been <br />completed prior to application for final plat approval or execution of the performance <br />contract shall be accepted as equivalent improvements provided the City Engineer shall <br />certify in writing that 'all said improvements conform to City standards. <br /> <br /> Subd.ll. Construction by City. The City shall have the right to <br />install such of the required improvements as it may elect and upon such terms and <br />conditions as it may deem appropriate under the circumstances. <br /> <br /> Subd.12. Warranty. The City shall, where appropriate, require a <br />subdivider submission of a warranty/maintenance bond in the amount equal to the original <br />cost of the improvements which shall be in force for one year following the final acceptance <br />of any required improvements and shall guarantee satisfactory performance of said <br />improvements. <br /> <br /> Subd.13. As Built PLans. Upon completion of installation of all <br />required improvements, the subdivider shall file with the City Administrator or designated <br />representative a tracing and two copies of plans and specifications showing all <br />improvements as finally constructed and installed. Such as-built drawings shall be certified <br />to be true and accurate by the registered engineer responsible for the installation of the <br />improvements. <br /> <br />9.50.57 Sidewalks and pedestrian ways. <br /> <br />Section 9.50.57 is hereby repealed and amended to read as follows: <br /> <br /> Subd. 1. All sidewalks and pedestrian ways required by the City shall be <br />constructed of a four inch concrete placed on a four inch (4") g-ravel base. Grades shall be <br />as approved by the City Engineer. Sidewalks shall be placed in the public fight-of-way <br />one foot from the property line and shall be a width designated by the City. <br /> <br /> Subd. 2. Construction of trailways All accessible <br />bikeway/walkway trailways shall be constructed of a minimum two inch (2") bitumionous <br />mat on a two inch (2") ~avel base.
