Duane Holmes. 18045 Waco Street stated h~s property adjoins Ute Street. in betWeen Waco and
Ute. He is also opposed to the location, and does not want a garage there. He believes it will
block the view when you come down the street, and the neighbor's house will be further back
than the shed. He indicated a shed should be in the back yard, not in~ front of the neighbor's
house.

Rick Bennett stated he lives north of the Rockows, and he is not sure what the issue is.. He
indicated he would prefer no garage was built and they just had: the: view of the trailers like they
have now. He stated his second choice would be to have it at a 30 foot. setback. He indicated he.
does not want the building in the backyard, as it would obstruct the view of the lake. He-
reiterated he does not know what the issue is. but is aware a few neighbors have been upset with
each other. He noted Mr. Rockow would be retiring in a few years and then the trailers will'be
gone.

Annette Banksted, 18021 Ute stated she would also prefer'no: building. She indicated there are
three trees blocking the trailers and she would like to see those removed also, since they block
her view of the lake. She stated when the trailers are gone, the'issue will be' gone and she does
not want a building in the wav.

Associate Planner Watd noted there were three letters received by Staff supporting granting of
the variance.

Dick Giddings, 18001 Ute indicated he does no;t. see why Mr: Rockow has to build a garage. He
stated the trailers are kept very neat. and are no problem. He does not want a garage built there,
and does not know why the issue cannot be left alone. He noted if'Mr. Rockow were to build the
garage on the other side' of the house he would have drainage problems.

Arnie Peltzer stated he likes around the lake. He' also does not think Mr. Rockow should have to
build a garage. He indicated he is only doing i-t because he is being asked to hide the trailers. He
thinks the City should drop the request to build a garage. He stated he planted pine trees to help
block them. and the trailers are not unsi:ghtly. He indicated Mr. Rockow is a good neighbor, and
he sees no reason for hh'n to have to build a garage. 'He stated this has been caused by a couple
of neighbors with a vendetta against others in the area, and except for them this problem would
notexist.

Chairperson Nixt indicated: this was an interesting situanon, and asked the applicant if he were
correct in thinking that- it' they could find a middle ~ound he would prefer not to build the
garage.

Mr. Rockow indicated that was correct. He read a letter he had sent to the City on January 30,
2004 indicating the trailers have been parked in the same location for 22 years, and noting the
steps they have taken to alleviate the concern of some neighbors. He noted that twice they
thought they had the matter resolved, and both he and the mayor talked to the complaining
neighbor and thought it was resolved, but evidently the neighbor changed his mind. He stated he
has talked with Staff about putting up a garage, which would not be his first choice. He indicated
he could not put the garage on the other side of the house because of the slope, a retaining wall,
and drainage issues. He explained he has four drivers, and the trailers would have to be moved
every, time anyone was going in or out of the garage. He. feels he should be able to use his
property 1:o~' his livelihood. He indicated he has not been able to find a middle ground. He stated

20
