RESOLUTION NO. CITY COUNCIL CITY OF RA~SEY WHEREAS, Mr. Van Odegaard, 5420 - 177th Lane N.W., Ramsey, Minnesota, has made application to the' City of Ramsey for a conditional use permit to operate a private kennel on his premises at 5420 -' 177th Lane N.W., Ramsey, Minnesota, legally described as Lots S and 6, Block 1, Riverwood Hills, Plat 1, and WHEREAS, t.he City has adopted Ordinance No. 73-6 and O?dinance · No. 76-4, which is an ordinance amending Ordinance No. ?3-6, and WHEREAS, in response to said private kennel conditional use permit application the City Council has adopted the following findings of fact: ~. 1. That. pursuant to the requirements of Ordinance 76-4, the City's Planning Commission held a duly advertised public hearing on the 19th day of April, 1977, the purpose of which ~as to take input · concerning the conditional use permit application. 2. That at a'duly called planning commission meeting held on April 19, 1977, which meeting was Subsequent to the abOve-described · public hearing, the Planning Commission adopted its findings of fact concerning the application, which findings of fact the City CounCil hereby adopts by reference and incorporates herein as if fully set forth. The Council further incorporates in their findings all the records and file of the Planning Commission concerning this application. 3. That based on its findings of fact, the Planning CommissiOn passed a resolution as follows: Motion by A1 Sorteberg to recommend to the City Council to deny this conditional use permit because of the findings of the Planning and Zoning Commission which include nuisances due to the noise of barking dogs., and odors emitting from kennel area and that a majority of citizens of this area are opposed to kennels in area of residential home{.~o..does not meet criteria for approval in Ordinance 73~4 ~nd'that the Planning Commission adopt finding of fact and further that they be given 90 days to comply with the ordinance ~,hen passed by the City Couacil. Motion seconded by Bradley Bodle. 4. That the City Council considered the Planning Commission recommendation at its regular meeting held on April 25, 1977. S. That both Mr. and b~rs.
