RESOLUTION NO. <br />CITY COUNCIL <br />CITY OF RA~SEY <br /> <br /> WHEREAS, Mr. Van Odegaard, 5420 - 177th Lane N.W., Ramsey, <br />Minnesota, has made application to the' City of Ramsey for a conditional <br />use permit to operate a private kennel on his premises at 5420 -' <br />177th Lane N.W., Ramsey, Minnesota, legally described as Lots S and <br />6, Block 1, Riverwood Hills, Plat 1, and <br /> <br /> WHEREAS, t.he City has adopted Ordinance No. 73-6 and O?dinance · <br />No. 76-4, which is an ordinance amending Ordinance No. ?3-6, and <br /> <br /> WHEREAS, in response to said private kennel conditional use <br />permit application the City Council has adopted the following findings <br />of fact: ~. <br /> <br /> 1. That. pursuant to the requirements of Ordinance 76-4, the <br />City's Planning Commission held a duly advertised public hearing on <br />the 19th day of April, 1977, the purpose of which ~as to take input <br />· concerning the conditional use permit application. <br /> <br /> 2. That at a'duly called planning commission meeting held on <br />April 19, 1977, which meeting was Subsequent to the abOve-described · <br />public hearing, the Planning Commission adopted its findings of fact <br />concerning the application, which findings of fact the City CounCil <br />hereby adopts by reference and incorporates herein as if fully set <br />forth. The Council further incorporates in their findings all the <br />records and file of the Planning Commission concerning this application. <br /> <br /> 3. That based on its findings of fact, the Planning CommissiOn <br />passed a resolution as follows: <br /> <br />Motion by A1 Sorteberg to recommend to the City Council to <br />deny this conditional use permit because of the findings of <br />the Planning and Zoning Commission which include nuisances <br />due to the noise of barking dogs., and odors emitting from <br />kennel area and that a majority of citizens of this area are <br />opposed to kennels in area of residential home{.~o..does <br />not meet criteria for approval in Ordinance 73~4 ~nd'that <br />the Planning Commission adopt finding of fact and further <br />that they be given 90 days to comply with the ordinance ~,hen <br />passed by the City Couacil. Motion seconded by Bradley Bodle. <br /> <br /> 4. That the City Council considered the Planning Commission <br />recommendation at its regular meeting held on April 25, 1977. <br /> <br /> S. That both Mr. and b~rs. Odegaard were present and represented <br />by counsel at the April 25, 1977, meeting. <br /> <br /> <br />
