RESOLUTION NO.' <br />CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br /> <br /> Whereas, a lawsuit has been commenced against the Mayor <br />and certain Council members of the City of Ramsey, said lawsuit <br />being entitled: <br /> <br />UNITED STATES DISTRICT COURT <br /> DISTRICT OF MINNESOTA <br /> FOURTH DIVISION <br /> <br />Donna F. Nelson, <br /> <br />Plaintiff, <br /> <br />-VS - <br /> <br /> Arnold Cox, Mayor, City of Ramsey, <br /> Minnesota, Individually and as Mayor <br /> of Ramsey; Gary Reimann, Individually <br /> and as a member of the Ramsey City <br /> Council; David Hickelson, Individually <br /> and as a member of the Ramsey City <br />Council; Gary Gotham, Individually and <br />~as a member of the Ramsey City Council, <br /> and Others not yet known, <br /> <br />Defendants. <br /> <br />and <br /> <br /> ~ereas, said lawsuit seeks damages from the defendants <br />both as individuals and as Mayor and/or Council'members for alleged <br />violations of Title 42, United States Code, Section 1983, and <br /> <br /> Whereas, as stated in the plaintiff's complaint, all <br />defendants were acting in their official capacity as City of Ramsey <br />Council members at all times with regard to the events complained <br />of in the complaint and <br /> <br /> I~ereas, it is the opinion of the Ramsey City Council that <br />the defendants were acting in good faith with regard to all events <br />complained of in the complaint, and <br /> <br />Whereas, MSA 466.07 provides in part as follows: <br /> <br />"The governing body of any municipality may defend, save <br />harmless, and indemnify any of its officers and employees, <br />whether elective or appointive, against any tort claim <br />or demand, whether groundless or otherwise, arising out <br />of an alleged act or omission occurring in the performance <br />of duty." <br /> <br /> <br />
