CASE

REQUEST FOR SPECIAL EVENTS PERMIT;
CASE OF GARY GRUBER, DIAMONDS SPORTS BAR AND GRILL
By: Jo Thieling, City Clerk
James Way, Police Chief
Dean Kapler, Fire Chief
Sylvia Frolik, Community Development Director

Background:

Staff received a request from Gary Gruber, owner of Diamonds Sports Bar and Grill, for a
Special Events Permit. The event is an outdoor music concert to be held on Saturday night, June
19, 2004. The event will be sponsored by Schell Brewing Co., of New Ulm and will feature two
live bands. The warm-up band will play music from about 7:00 p.m. to 8:30 p.m. with the
headliner band to start at approximately 8:30 p.m. and continue to 11:00 p.m. Mr. Gruber will be
informed that he must maintain a 20-foot clear path at all times for route-in/route-out for
emergency vehicles. Mr. Gruber is planning to be present at the meeting to answer any questions
Council may have.

Thus far, staff has informed Mr. Gruber that he must have a minimum of two Ramsey Police
Officers on site, even though the plan is to have hired security present. Police Chief Way feels
that the amount of people expected, the fact that alcohol is involved, and the impact this will
have on traffic, warrants the hiring of at least two officers.

When the 2004 rates and fees were adopted, Council stated that the fee for a special events
permit would be determined per event by the City Council. As per staff's request, Mr. Gruber
has placed $1,000 into an escrow account to pay for billable staff time (Police, Administrative,
Public Works), and an additional $500 into an escrow to guarantee clean-up after the event.
Someone fi:om Public Works will visit the premises on Monday morning to do an inspection
with regard to the clean-up. Any monies left in the escrow account following the event will be
reimbursed to Mr. Gruber. If for some reason there is a shortage, Mr. Gruber will be billed for
that amount.

Staff is concerned there will be numerous noise complaints if the band is allowed to play until
11:00. Council may wish to offer an alternative stop time. Council may also wish to have input
with regard to the fee being charged.

Council Action:

Based upon discussion.

Reviewed by:

City Clerk
Police Chief
iFire Chief/Director of Public Works
Community Development Director
Finance Officer

CC: 03/23/04
