I <br />I <br />I <br />I <br />I <br />I <br />I <br />i <br />I <br />I <br />I <br />i <br />I <br />! <br />! <br />I <br />I <br /> <br />The plumbing inspector may cause to be assessed against the property on which <br />an individual sewage treatment system is located the cost of proper closure, <br />restoration, and cleanup of pollution occurring as a result of a system failure. <br />Upon certification by the accountant of the cost incurred, the City Admini- <br />strator shall cause the cleanup assessment to be levied against the property <br />on which the system is located. <br /> <br />150.0~9B LIABILITY <br /> <br />The plumbing inspector or any employee charged with the enforcement of this <br />chapter, acting in good faith and without malice for the city in the discharge <br />of his duties, shall not thereby render himself liable personally, and he is <br />hereby relieved from all personal liability for any damage that may accrue to <br />persons or property as a result of any act required or by reason of any act or <br />omission in the discharge of his duties. Any suit brought against the plumbing <br />inspector or employees because of such act or omission performed by him in the <br />enforcement of any provision of this chapter shall be defended by the legal de- <br />partment of the City of Ramsey until final termination of the proceedings. <br /> <br />150.019C COOPERATION OF OTHER OFFICIALS <br /> <br />The plumbing inspector authority may request, and shall receive so far as may <br />be necessary in the discharge of his duties, the assistance and cooperation <br />of the other officals of the City of Ramsey. <br /> <br />150.0110 APPEALS <br /> <br />Appeals from the plumbing inspector's decision and requests for variances as <br />to any provisions of this chapter may be made to the Ramsey City Council. The <br />city council .may grant a variance to the strict terms or requimements of this <br />chapter as it affects specific tracts of land ~f it finds~ <br /> <br />a) It is shown by ~eason of topography or other physical condi- <br />ditions that strict compliance wi~h the ordinance's mequirements <br />could cause an exceptional and undue hardsh~p to the enjoyment <br />of a substantial property right; <br /> <br />b) By the granting of the variance, the spirit and intent of <br />the chapter will not be adversely affected; <br /> <br />c) That the variance will not be injurious to the health and/or <br />general welfare of: <br /> <br />(.i) the users of the system for which the variance is sought. <br />(ii) the adjacent property owners, and <br />(.iii) the general community as a whole; <br /> <br />d) That the establishment, maintenance or operation of the system <br />as permitted by the variance will not be detrimental to or e:~danger <br />the public health, safety or general welfare and is not contrary to <br />established standards, regulations or ordinances of other go-Tern- <br />mental agencies. <br /> <br /> <br />
