I I The plumbing inspector may cause to be assessed against the property on which an individual sewage treatment system is located the cost of proper closure, restoration, and cleanup of pollution occurring as a result of a system failure. Upon certification by the accountant of the cost incurred, the City Admini- strator shall cause the cleanup assessment to be levied against the property on which the system is located. 150.0~9B LIABILITY The plumbing inspector or any employee charged with the enforcement of this chapter, acting in good faith and without malice for the city in the discharge of his duties, shall not thereby render himself liable personally, and he is hereby relieved from all personal liability for any damage that may accrue to persons or property as a result of any act required or by reason of any act or omission in the discharge of his duties. Any suit brought against the plumbing inspector or employees because of such act or omission performed by him in the enforcement of any provision of this chapter shall be defended by the legal de- partment of the City of Ramsey until final termination of the proceedings. 150.019C COOPERATION OF OTHER OFFICIALS The plumbing inspector authority may request, and shall receive so far as may be necessary in the discharge of his duties, the assistance and cooperation of the other officals of the City of Ramsey. 150.0110 APPEALS Appeals from the plumbing inspector's decision and requests for variances as to any provisions of this chapter may be made to the Ramsey City Council. The city council .may grant a variance to the strict terms or requimements of this chapter as it affects specific tracts of land ~f it finds~ a) It is shown by ~eason of topography or other physical condi- ditions that strict compliance wi~h the ordinance's mequirements could cause an exceptional and undue hardsh~p to the enjoyment of a substantial property right; b) By the granting of the variance, the spirit and intent of the chapter will not be adversely affected; c) That the variance will not be injurious to the health and/or general welfare of: (.i) the users of the system for which the variance is sought. (ii) the adjacent property owners, and (.iii) the general community as a whole; d) That the establishment, maintenance or operation of the system as permitted by the variance will not be detrimental to or e:~danger the public health, safety or general welfare and is not contrary to established standards, regulations or ordinances of other go-Tern- mental agencies.
