I <br />I <br />I <br />I <br />I <br /> <br />I <br />i <br />I <br /> <br />i <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br /> <br />QUAD CITIES CABLE CO~b~ICATiONS COP~ISSION <br />SPECIAL MEETING <br /> <br /> September 8, 1983 <br /> <br />The special meeting of the Quad Cities Cable Communications Commission was <br />called to order by Chair Dan Hartman at 5:10 p.m. at Group W offices in the <br />Cotten's Building in Anoka. Members present: Dean Rick, Sue Van Wagner, <br />Donald Jacobson, Jerry Dulgar, Donald Melrose, John Beissel and Alternate <br />Ben Deemer. Member absent: Pat Lindquist. Staff present: Attorney <br />Thomas Creighton. Group W: Terrence O'Connell, Roger Franke, Dick Beens, <br />and Janet Fleming. <br /> <br />Mr. O'Connell presented Group W's Progress Report as of September 8. He <br />explained what was complete in each of the cities. Also, he showed maps of <br />Ramsey and Andover and described which areas needed to be completed. There <br />are presently 13 homes hooked up for testing. On Tuesday, September 6 <br />Group W began marketing in Anoka. Within two weeks marketing will begin in <br />all of the communities. Mr. O'Connell stated that the maximum installations <br />per day would be 90. <br /> <br />Donald Jacobson questioned Terry O'Connell as to whether or not. Group W felt <br />that they made their schedule per the 93 day extension. Mr. O'Connell stated <br />that the system was not totally operational. Dan Hartman questioned exactly <br />what was operational as of today. Mr. O'Connell said that all of Anoka, one- <br />half of Champlin, 80% of Andover and a small percentage of Ramsey for a total <br />of approximately 90% completion in all cities. Attorney Thomas Creighton <br />questioned when the last area would be able to hook up. l~r. O'Connell <br />explained that they were three weeks behind im completion, but all areas would <br />be able to hook up by October 1. He also pointed out that the equipment <br />that was used was far superior to what was proposed. Mr. O'Connell said that <br />the proposal called for a total of 169 miles of cable, when in fact Group W <br />has built 329 miles. Therefore, the mileage in the proposal was drastically <br />underestimated. <br /> <br />Dan Hartman questioned Thomas Creighton concerning the 93 day extension. <br />Mr. Creighton said that the extension was until 5 p.m. on September 12 and <br />that the Act.,of God Clause was not part of the agreement. Mr. Creighton <br />pointed out that the Commission has three choices: 1) to decide that <br />Group W made a reasonable effort to complete the system and waive the $186,000 <br />fine; 2) Anoka and Champlin could assess Group W $500/City and R~m~ey and <br />Andover up to $2,000/day from September 13; 3) or choose to do nothing and <br />waive the fines. <br /> <br />Donald Melrose questioned the effect of the storm damage on the completion <br />date. Terry O'Connell explained that this caused adelay of 10 days. Donald <br />Jacobson stated that it was a better system than originally proposed, that <br />more people would be able to hook up and he felt that the Commission should <br />state that Group W made reasonable progress. Donald Melrose agreed with <br />Mr. Jacobson. Jerry Dulgar suggested that the Commission not take a vote today, <br />but wait until the September 15th meeting. It was recor~nended than all the <br />cities concur with the Commission's recommendation. <br /> <br /> <br />
