I <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />i <br /> <br />QUAD CITIES CABLE COMML'i'~ICATIONS COMMISSION <br /> <br /> SPECIAL MEETING <br /> <br /> November 9, 1983 <br /> <br />An executive session of the Quad Cities Cable Communications Commission was <br />called to order at 5:58 p.m. by Chair Dan Hartman with members: Don Jacobson, <br />Pat Lindquist, Don Melrose, Jerry Dulgar, Dean Rick, John Beissel and Ben Deemer <br />present. Member absent: Sue Van Wagner. Staff present: Thomas Creighton. <br />The reasons for the executive session was to brief the Commission on the <br />negotiations held with the Executive Committee and Group W and the possibility <br />of litigation. <br /> <br />The special meeting was called to order at 6:12 p.m. Represent/rig Group W: <br />Terrence O'Connell. Chair Hartman proceeded to explain the memo from Mr. Creighton <br />explaining the terms of the compromise with Group W. Don Jacobson questioned <br />if the Commission and Group W agree to this memo will this be in exchange for <br />no fine at this time. Mr. Creighton stated it would. <br /> <br />Don Jacobson wondered if the Commission accepts this compromise at a later can <br />the Commission go back and fine Group W. Mr. Creighton explained that the <br />Commission could fine for other things, but not construction. <br /> <br />It was also explained that the $24,000 Group W is to pay the Commission is from <br />lost revenues, attorney's fees and $7,640 to go toward the grant for access. <br /> <br />Dan Hartman questioned if the Commission should put the rate freeze adjustment <br />before the Council's now or on October 20, 1985, Hr. Creighton suggested doing <br />this on October 20, 1985. <br /> <br />Don Melrose felt the Commission should stick wtth the three year rate freeze. <br />Mr. Jacobson agreed with this. Ben Deemer wondered what date the rate freeze <br />would go into effect. Hr. Creighton explained that it was when the <br />construction was complete which was October 20, 1983. <br /> <br />Hr. Creighton felt that if the Commission didn't adjust the rate freeze that <br />if the rates increased 20% in two years in three years it would be possible to <br />have a 30% rate increase. <br /> <br />Ben Deemer questioned the dollar amount of $3,000 for promotional campaign. <br />Mr. O'Connell said that Group W did not want to spend any money in this area <br />until he met with the subcommittee. <br /> <br />Don Jacobson feels he cannot vote for the memo of compromise. He said that it <br />doesn't go along with the memorandum of agreement that was signed in June. <br /> <br />Jerry Dulgar questioned the 5% of gross revenues. Would thia take effect for <br />all of 83 or after November 1. Mr. Creighton felt this would be in effect for <br />all of 83. <br /> <br />Don Melrose moved to adopt the memo regarding Group W's compromise, except for <br />~6. He would reduce the rate freeze from 3 years to 2½ year~.. Jerry Dulgar <br />seconded the motion. Pat Lindquist, Dar~ Hartm~n, John Beiss~l, Jerry Du!gar <br />and Don Melrose voted yes.' Don Jacobsor, Ben Deer~er and Dea:. Rick voted no. <br />?~.',~ion carried 5-3. <br /> <br /> <br />
