I <br /> Motion by Councilmember Yam Wagner to introduce the following Resolution: <br />I RESOLUTIO~ 83-134 <br />i MRERKAS, the Ramsey City Council by motion on November 13, 1978 and <br /> again reaffirmed on April 26, 1983 granted a subdivision variance to permit the <br />I subdivision of Lot 2, Block 2, Whispering Pines Plat 4 into two (2) equal lots <br /> using a platted description, and <br /> <br />I ~HKREA$, the legal description used for said division is not accurate <br /> as it does not divide said Lot 2, Block 2, into two (2) equal lots as is the <br /> intent of the subdivider, and <br /> <br />I WHEREAS, the only to equally divide said Lot Block 2 is the <br /> way <br /> 2, <br /> by <br /> use of a metes and bounds description, and <br /> <br />I NHERKAS, the City Council n~. finds that it would create an undue <br /> hardship on the property owner to not grant the variance to permit a metes and <br /> bounds subdivision of said Lot 2, Block 2. <br />I WO~, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br /> That Lot 2, Block 2, Whispering Pines Estates, Plat 4, Anoka County, <br />I Minnesota, may be subdivided into two (2) equal lots using the following metes <br /> and bounds legal descriptions: <br /> <br /> A) The North 173.9 feet of Lot 2, Block 2, Whispering Pines Estates, <br /> Plat 4, as measured along the East line thereof. <br /> <br /> I B) Lot 2, Block 2, Whispering Pines Estates, Plat 4, except the North <br /> 173.9 feet, as measured along the East line thereof. <br /> <br /> The foregoing Resolution was seconded by Councilmember Schlueter and upon vote <br />I being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Gamec, Counctlmember $chluter, Reimann, Van Wagner <br />I and Sorteberg, <br /> and the following voted against the same: <br />I None <br /> whereupon said lesolutioT wss declared duly passed and adopted on this <br />I 23r~d day of August, 1983 <br /> <br />I <br /> <br /> <br />
