Councilmember Van Wagner introduced the following resolution and moved for <br />its adoption: <br /> <br /> RE~OL~ION ~83-152 <br /> <br />RESOLUTION OPPOSING S~NAT~ FILE e66 {U. S. S~ ~ D~TION BI~) <br />~GI~ ~ DE~ OF ~ ~ION ~O~S~ ~N ~ U. S. HOUSE OF <br /> <br /> ~~, Cable Television is a local system using municipal pro~rty <br />and municipally held easements over private pro~rty; and <br /> <br /> ~~, Cable Television is, by its nature and by virtue of public <br />need, a local, not a national co~unications medium; and <br /> <br /> ~~, local and state governments have ~en successful in providing <br />a reasonable regulatory framework for the full development of Cable Television <br />to serve local consumers; and <br /> <br /> ~, there has ~en no showing of any overriding national interest <br />in Cable Television which cannot ~ acco~odated within the present system <br />of state/local regulation; and <br /> <br /> ~~, we assert that gove~mental powers are best exercised at <br />the local level unless an ove~helming national interest cannot be fulfilled <br />by state and local governments; and <br /> <br /> ~, S.~66 (U. S. Senate Bill) strips state and local governments <br />of most authority they now have to secure good Cable Television service for <br />their co,unities and their constituents, to the ha~ of both. <br /> <br />~W ~~, BE IT ~OL~ BY ~ C~ ~IL, C~ OF ~, ~ ~, <br /> STA~ OF NI~A, as <br /> foll~s: <br /> <br /> 1) There is no justification for the Federal Government to preempt <br /> state and local authority over Cable Television. <br /> <br /> 2) Powers to regulate local systems are best exercised by local <br /> units of government. <br /> <br /> 3) S.166 (U. S. Senate Bill) is an ~justified and ~wise intrusion <br /> of Federal Government in a local ~nner. <br /> <br /> 4) The Ramsey City Co~cil calls on all members of the U. S. House <br /> of Representatives to protect and preserve presently held state and local <br /> authority to assure that local Cable Television systems satisfy local co~ity <br /> interest. <br /> <br /> 5) Copies of this resolution ~ circulated to all mem~rs of Congress <br /> and other interested parties. <br /> <br /> The motion for the adoption of the foregoing resolution was duly seconded by <br /> Councilmem~r Reimann and u~n vote being taken thereon, the following voted <br /> in favor thereof: <br /> <br /> Mayor Gamec, Councilmem~rs Van Wagner, Reimann, Sorteberg, Schlueter <br /> <br />Resolution #83-152 <br />Page 1 of 2 <br /> <br /> <br />
