Berg <br /> <br />RE: Hunt/Miller Fence Dispute <br /> <br />In your letter of September 15, 1983, regarding the above subject, you <br />asked me to make a determination of the legality of a fence referred to <br />in a letter dated September 8, 1983 from Kenneth Miller and Lydia Miller. <br />For your information, a copy of that letter is attached to this memo. <br /> <br />As stated by the Millers, the fence in question is seven (7) feet high <br />and topped with three (3) strands of barbed wire. The fence is located <br />in the I-1 Industrial Zoning District of the City. <br /> <br />The City presently has of record the following Code sections relating to <br />fence regulations: <br /> <br />1) Section 170.014H par. 6 <br /> <br />In Residential districts, fencing other than for solely <br />decorative purposes shall be restricted to side and rear <br />yards, maximum fencing heights in residential districts <br />shall be six (6) feet, except eight (8) feet shall be <br />allowed where neighboring land asthetic values are not <br />adversely affected (emphasis added). <br /> <br />2) Section 170.015I(6) par. VIII (C)2 <br /> <br />In the U__R, U__~C, UER and UMB Districts: <br /> <br />2) Fences, walls and hedges: Notwithstanding any <br />other provisions of this code, fences, walls and <br />hedges are permitted in or along the edge of any <br />residential yard, provided that no fence, wall or <br />hedge except a retaining wall is the required front <br />yard setback of any interior lot shall be over <br />forty-two (42) inches in height. On a corner lot, <br />nothing shall be placed or allowed to grow in such <br />a manner as to impede vision between heights of <br />three (3) and ten (10) feet above the centerline <br />grades of the intersecting streets. The latter <br />limitation shall apply to that triangular area <br />within sixty-five (65) feet of the center of the <br />intersection (emphasis added). <br /> <br /> <br />
