CASE %4= R~UEST FOR A BUILDING P~RMIT~ CASE OFMR: DAVID SCBMEDEKE= <br /> <br /> Mr. David Schmedeke, owner of the property at 7157 West Highway %10 where <br /> the car located, requesting to build a pole <br /> used <br /> lot <br /> is <br /> is <br /> authorization <br /> building at that location. The Board of Adjustment granted Mr. Schmedeke <br /> a variance on July 10, 1978 to construct the building if he placed a brick <br /> facing on 50% of the side facing T. H. #10 and 100% on the side facing <br /> Ramsey Blvd. NW. In discussing this issue with the City Attorney, we've <br /> been informed that the variance is still valid inasmuch as the ordinance <br /> does not have a limitation on the length of time the variance remains in <br /> effect. We can see no problems with this but, as in 1978, no plans have <br /> been prepared for the building. Therefore, inasmuch as the construction <br /> has been previously approved, we feel it would be appropriate to allow <br /> the individual to at buil~ according to the following: <br /> build <br /> this <br /> time <br /> if <br /> he <br /> <br /> 1) That the building shall be completed as approved by the Board <br /> of Adjustment at their meeting of July 10, 1978. <br /> <br /> 2) That the applicant shall submit prior to any construction, plans <br /> signed by an architect or engineer registered under the laws of the State <br /> of Minnesota in compliance with the State Building Code. <br /> <br /> 3) That the applicant shall enter into a contract with the City <br /> guaranteeing compliance State codes. <br /> with <br /> both <br /> and <br /> local <br /> <br /> Enclosure (D3-d) contains the following items for your consideration: <br /> <br /> a) Applicant's application <br /> b) Board of Adjustment meeting minutes dated July 10, 1978 <br /> <br /> C~uncil Action: If you concur, then a motion to approve the request and <br /> authorize the Mayor and City Administrator to enter into an agreement <br /> stipulating those things as listed above would be appropriate.
