CASE %4= R~UEST FOR A BUILDING P~RMIT~ CASE OFMR: DAVID SCBMEDEKE= Mr. David Schmedeke, owner of the property at 7157 West Highway %10 where the car located, requesting to build a pole used lot is is authorization building at that location. The Board of Adjustment granted Mr. Schmedeke a variance on July 10, 1978 to construct the building if he placed a brick facing on 50% of the side facing T. H. #10 and 100% on the side facing Ramsey Blvd. NW. In discussing this issue with the City Attorney, we've been informed that the variance is still valid inasmuch as the ordinance does not have a limitation on the length of time the variance remains in effect. We can see no problems with this but, as in 1978, no plans have been prepared for the building. Therefore, inasmuch as the construction has been previously approved, we feel it would be appropriate to allow the individual to at buil~ according to the following: build this time if he 1) That the building shall be completed as approved by the Board of Adjustment at their meeting of July 10, 1978. 2) That the applicant shall submit prior to any construction, plans signed by an architect or engineer registered under the laws of the State of Minnesota in compliance with the State Building Code. 3) That the applicant shall enter into a contract with the City guaranteeing compliance State codes. with both and local Enclosure (D3-d) contains the following items for your consideration: a) Applicant's application b) Board of Adjustment meeting minutes dated July 10, 1978 C~uncil Action: If you concur, then a motion to approve the request and authorize the Mayor and City Administrator to enter into an agreement stipulating those things as listed above would be appropriate.
