<br />On or before September 12, 1983, Group W shall construct all insti-
<br />tutional cable network points as listed in the franehise ordinanee,
<br />providing to said points all required character generators and
<br />rnudems. The institutional cable net~vork will be fully operational
<br />on or before sixty (60) days after September 12, 1983. Two (2) T
<br />Sub-Rand frequencies shall be made available on or before Septerber
<br />12, 1.q83, on the subscriber network for returning signals frcm all
<br />institutions designated in the franchise until such time as the
<br />institutional cable network is fully activated.

<br />All character generators and modems proposed in the Offering of
<br />Group W to be made available to the Connission shall be made
<br />available on or before Septenber 12, 1983.
<br />
<br />The ~o,~ission stated that upon reasonable determination that Group W had
<br />eOnOlied with the above, the Co-ffnission, on behalf of its rnerrber cities, shall
<br />waive all ri~ht and claim to $186,000 in fines, which v~uld have aect~ulated
<br />from June 11, 1083, to Seoterber 12, 1983.

<br />q'he O~mnission further stated that if Group W failed to eo-nplywith the revised
<br />construction schedule as of 5:00 O.m., Sept~rber 12, 1983, the C~-rmission shall
<br />proceed to collect franGroupW the $186,000. Further, until the C~vrnission
<br />determines that requirements stated above have been eanplied with by Group W,
<br />said eor~nvwill be fined beginning 9eptffnber 13, 1983, and every day
<br />thereafter said violation continues, T~voThousand and No/100 Dollars ($2,000.00)
<br />ocr day.

<br />It is irroortant to note that the a~re~nt entered into in June of 1983 did not
<br />relate to or release in anyway to GroupW's responsibility to otherwise ccrrply
<br />with the nurrerous pranises and representations in their proposal to the cable
<br />ecrrmission and the n~er eities. OroupWCable was selected, ~rnong other
<br />things, on the basis of the superiority of its proposal over Heritage
<br />C~Ju,-~Jnieations and Tribune C~m~unications. High on the list of priorities of
<br />the eable ecrnnission and its merrber cities was the two-~y interaetivity of the
<br />cable system, its service to institutions, its service to education, its local
<br />origination offering., both facilities and staff, and its public access
<br />offerings, both facilities and staff. Among other things, OroupWproposed a
<br />full color studio at the C~arnolin hub-site, a full color studio at the headend
<br />for access purposes and a color rrobile van. After later discussion with the
<br />C~rmission, it v~s determined that the C~amplin studio should be n~ved to the
<br />Anoka headend although the staff and equipment v~uld relaxin the sarre. GroupW
<br />also proposed 5 color porta-paks, five to be located at the studio locations and
<br />the fifth at the Anoka Senior High School.
<br />
<br />C, roup W's ecrrmitment to local origination access pro~ ranming in its operating
<br />budget was $112,000 for the first year with a staff c~rrrnitn~nt for the first
<br />year of {;32,000 in local origination and $47,000 in access. The first year
<br />began on the date of the Cable Board's issuance of the Certificate of a
<br />Confirmation, June 11, 1982. The svstem is now rmre than one year and three
<br />months into that process.
