I I I I I Punch List # Comments Further Discussion: Chairman Heitman stated that he is not interested in stifling the City in any way, shape or form, that he wants an opportunity to voice his opine,on and he wants to be sincerely listended to. Commissioner Sieber stated that if we have a responsive Council, the City will run well; if we have an unresponsive Council, the City will not run well -- charter not with- standing. Commissioner Data dismissed himself from the meeting at this time. Chairman Heitman called for a vote to the motion on the fl oor. I I I I I 20 21 Motion carried. Voting Yes: Chairman Heitman, Commissioners Sieber, Buchanan, Titterud, Greenberg, Bauerkemper, Lichter, Buchanan. Voting No: None. Absent: Commissioners Data and Gamec. This item will remain as a punchlist item until the Commission receives a reply from the Attorney General's office. Commission consensus is to strike this item from the punchlist. Commissioner Sieber noted that the past procedure has been by special assessments and the only fair way to continue is by special assessments. Further amendments to the charter draft were discussed at this time. Motion by Commissioner Buchanan to change Section 8.04.01 to read as follows: 'All improvements to be paid for by special assessments against the benefitted property shall be instituted by a petition of at least 35% of the benefitted property owners together with an ordinance adopted by an affirmative vote of the majority of all of the Council or Commissioner Buchanan was interrupted at this point. The Commission discussed the two issues involved with commissioner Buchanan's motion: 1. Deleting phrasing that 4/5 of Council can order a project in. 2. Changing the acting of ordering a project in from resolution to ordinance. Commissioner Lichter noted that it is not necessary to revise this section because in further reading, this section does allow for a counter-petition. The motion failed for a lack of second. Motion by Commissioner Buchanan to amend the first sentence of Section 8.04.01 to read as follows: 'All improvements to be paid for by special assessments against the benefitted property shall be instituted by the petition of at least 35% of the benefitted property owners together with a resolution adopted by an CC/September 22, 1983 Page 6 of 8
