I <br />I <br />I <br />I <br />I <br /> <br />Punch List # <br /> <br />Comments <br /> <br />Further Discussion: Chairman Heitman stated that he is <br />not interested in stifling the City in any way, shape <br />or form, that he wants an opportunity to voice his <br />opine,on and he wants to be sincerely listended to. <br />Commissioner Sieber stated that if we have a responsive <br />Council, the City will run well; if we have an unresponsive <br />Council, the City will not run well -- charter not with- <br />standing. <br /> <br />Commissioner Data dismissed himself from the meeting <br />at this time. <br /> <br />Chairman Heitman called for a vote to the motion on the <br />fl oor. <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br />20 <br /> <br />21 <br /> <br />Motion carried. Voting Yes: Chairman Heitman, <br />Commissioners Sieber, Buchanan, Titterud, Greenberg, <br />Bauerkemper, Lichter, Buchanan. Voting No: None. <br />Absent: Commissioners Data and Gamec. <br /> <br />This item will remain as a punchlist item until the <br />Commission receives a reply from the Attorney General's <br />office. <br /> <br />Commission consensus is to strike this item from the <br />punchlist. <br /> <br />Commission consensus-is-to'strike this item from the <br />punchlist. Commissioner Sieber noted that the past <br />procedure has been by special assessments and the only <br />fair way to continue is by special assessments. <br /> <br />Further amendments to the charter draft were discussed at this time. <br /> <br />Motion by Commissioner Buchanan to change Section 8.04.01 to read as follows: <br />'All improvements to be paid for by special assessments against the benefitted <br />property shall be instituted by a petition of at least 35% of the benefitted <br />property owners together with an ordinance adopted by an affirmative vote of <br />the majority of all of the Council or <br /> <br />Commissioner Buchanan was interrupted at this point. The Commission discussed <br />the two issues involved with commissioner Buchanan's motion: <br /> <br />1. Deleting phrasing that 4/5 of Council can order a project in. <br /> <br /> 2. Changing the acting of ordering a project in from resolution to ordinance. <br /> <br />Commissioner Lichter noted that it is not necessary to revise this section <br />because in further reading, this section does allow for a counter-petition. <br /> <br />The motion failed for a lack of second. <br /> <br />Motion by Commissioner Buchanan to amend the first sentence of Section 8.04.01 <br />to read as follows: 'All improvements to be paid for by special assessments <br />against the benefitted property shall be instituted by the petition of at least <br />35% of the benefitted property owners together with a resolution adopted by an <br /> <br />CC/September 22, 1983 <br /> Page 6 of 8 <br /> <br /> <br />
