Mr. Gilbertson indicated that his purpose in subdividing is <br />to allow for future individual ownerships. He also stated that an easement <br />is proposed between Tracts B and C, providing access to Tract A, and that <br />easement will be wider than City code requires for City streets, each of the <br />proposed tracts have on-site sewer system that meets Code, proposed parking <br />area also meets Code. <br /> <br />City Attorney Goodrich stated that if Council approves Mr. Gilbertson's <br />request, Council should note their reasons for doing so as it would be in <br />conflict with P&Z recommendation. <br /> <br /> I <br />I <br /> I <br /> I <br /> I <br />i <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br /> <br />Council consensus is that Mr. Gilbertson is faced with a real problem, <br />that a solution should be worked out and that approving Mr. Gilbertson's <br />request would not change anything as the total parcel is already developed <br />and Mr. Gilbertson's proposed plan is adaptable in the event sewer and water <br />are brought to the subject area and a frontage road being constructed <br />parallel to the railroad tracks. <br /> <br />Council added the following items to the Findings of Fact: <br /> <br />8. Subject property is already developed with existing buildings. <br /> <br />9. Tract A would have to be served by a private easement and Tract A <br /> would have no frontage on a public street. <br /> <br />10. Common parking access for all three businesses. <br /> <br />11. Not to approve would create undue physical and financial hardship <br /> to the applicant. <br /> <br />Council deleted the following item from the Findings of Fact: <br /> <br />4. That a similar request to subdivide by metes and bounds was refused <br /> at the March 22, 1983 Council meeting. <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember Reimann to <br />adopt the findings of fact regarding Mr. Jim Gilbertson's request to <br />subdivide by metes and bounds his property along Highway #10 NW that includes <br />the Discount #10 Liquor Store, Bar De Rentals and theN.H.C. Building° <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, <br />Schlueter and Van Wagner. Voting No: None. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Van Wagner to <br />adopt Resolution #83-73 to allow Mr. Jim Gilbertson the proposed metes and <br />bounds subdivision creating Tracts A, B, and C, that Tract A will hav~.p~ivate <br />access and permission for a private easement is hereby granted and said <br />easement shall be 66' in width. (Refer to resolution file for Res. #83T73). <br /> <br />Further Discussion: Mr. Clayton Berg suggested that the easement to Tract A <br />run through Tract A to the railroad tracks in order to possibly serve utilities. <br />Mr. Gilbertson agreed that it would. Mr. Goodrich stated that in the best <br />interest of the public the private easement should be a public ingress/egress <br />street. <br /> <br />C/April'26, 1983 <br />Page 28 of 30 <br /> <br /> <br />
