LICENSI~ PROVISIONS. <br /> <br /> ~ctlo~ [. Unless otherwise provided by this ordinance or the County Board, no <br />perm, partnership, corporatian, or any en.ti.~, shall, make nor allow property under his or its <br />control to be used for intermediate or final alsposol at any solid waste, except at a site or <br />facility for which a Iicerae has been issued by the Department or the County Board before <br />operation commences. A license shall not be required for any site used for the disposal of <br />solid waste from a single family or household, a member of which is the occupant of the <br />property, but such site shall be operated and maintained in a nuisance free and aesthetic <br />manner consistent with the intent of this ordir~ance. Any site or focillty to be used for any <br />method of solid waste disposal not otherwise provided for in this ordinance must be licensed <br />by the County Board before operation may be commenced. <br /> <br /> Subsection 2. Any license obtained under this ordinance shall be nontransferroble. <br />Licenses issued to corporations shall be valid only so long as there Is no change in the <br />officers, charter, articles, by-laws or ownership of the corporation unless such change is <br />approved by the County Board, in which event said license shall continue in force until the <br />end of the then current license year. Licenses issued to associations or partnerships shall be <br />valid only so long as there is no change in the partnership or association agreement or in the <br />ownership of said association or partnership unless such charxJe is approved by the County <br />Board, in which event said license shall continue in force until the end of the then current <br />license year. Corporations~ partnerships or assaciatioe~s holding licenses shall submit written <br />notice to the County Auditor of any such ch~ __aesc__ribed herein on or before thirty (30) <br />days prior to the effective date of any such change. In the case of a corporation, the <br />licensee shall notify the County Auditor when a person not listed in the application acquires <br />an intere~t~ and shall give all information about said person as is required of a perso¢~ <br />pursuant to the provisions of this ordinance. <br /> <br /> Subsection 3, An application for a license to operate an intermediate or final solid <br />waste disposal facility shall be submitted to the Department, The application shall not be <br />considered complete until the Department receives all of the following materials showing <br />satisfactory compliance with this ordinance: <br /> <br />A. Plans, specifications, reports, prepared by a registered professional engineer of <br /> Minnesota, showincj~ <br /> <br />I) <br /> <br />A current map or aerial photograp~ of the area showing land use and zoning <br />within ono fourth (I//~) mile of the solid waste disposal site. The map or <br />aerial photograT~ shall be of sufficient scale to show all homes, buildings, <br />lakes, ponds, water courses, wetlands, dry runs, rock outcroppings, roads, <br />and other applicable details ~ shall indicate the general topography with <br />contours and drainage patterns. Wells shall be identified on the map or <br />aerial photograph. United States Geological Survey datum shall be <br />included and a north arrow drawn. A location insert shall be included. <br /> <br />2) <br /> <br />A plot plan including legal description of the site and immediate ndjocent <br />area showing dimensionst location of soil boringsf present and planned <br />pertinent features including but not limited to roads, fencing and cover <br />stockpiles. The plan of development including any excavation, trenching <br />and fill shall be shown progressively with time. Cross sections shall be <br />included an the plot plan or an separate sheets showing progressively with <br />time the original and proposed elevation of excavation, trenching and fill. <br />The scale of the plot plan should not be greater than 200 feet per inch. <br /> <br />3) <br /> <br />An ultimate land use plan, including intermediate stages, identifying the <br />total ~ complete land use and showing finished contour lines ~ <br />elevations. The scale of the ultimate land use plan shall not be greater <br />th(~ 200 feet per inch. <br /> <br />report shall accamix~y the plans indicating: <br /> <br />a) Population ~ area~ expected to be served by the proposed site. <br /> <br />b) Anticipated type, quantity and source of material to be disposed of at <br /> the site or facility. <br /> <br />-3- <br /> <br /> <br />
