The licensing requirements of Section II shall be applicable to <br />demolitio~ landfills except that the.C.ounty Board may waive requirements not reasonably <br />necessary based upon the charocter,shcs of the waste, the site or the service proposed. <br /> <br /> Subsection 2. The constructio~ requirements, o~erational procedures c~l closure and <br />post-closure requirements of Section V, applying to sanitary landfills, shall be applicable to <br />demolition landfiUs, except that the Coe~ty Board may waive requirements which are not <br />reaso~ly necessary based upon the characteristics of the waste, the site, or the service <br />proposed. <br /> <br /> Subsection 3. In addition to the foregoing requirements, the following requirements <br />shall apply: <br /> <br /> A. No public uscxje will be aUowed except where specifically approved by the <br /> County. <br /> <br />Before ony materials from demolished structures may be deposited, the licensee <br />must submit proof acceptable to the Defxu-trnent that the demolished structure <br />has been subjected to satisfoctory pest erodlcation prior to demolition. <br /> <br />Ce <br /> <br />No paper, plastic, cardboard, carts, bottles, tires, appliances, vehicles, or other <br />refuse materials not specifically permitted by this ordinance shall be deposited, <br /> <br />A site shall be considered finished or closed, and require final cover when the <br />site can no longer reasonably be used for the disposal of demolition waste and/or <br />a current license is not in effect. <br /> <br /> Subsection b,. The Department is hereby authorized to issue clean fill demolition <br />landfill licenses upon the applicant complying with this ordinance, except for those <br />provisions specifically waived by the Department, and payment of the appropriate fees. <br />C)~ce the Department decides upon the disposition of an applicatian it shall notify the <br />applicant of its decision in writing. If the applicant feels aggrieved by the Dep~tment's <br />decision, he may invoke the procedural rights provided by Sectio~ III of this ordinance. <br /> <br /> Subsection S. A clean fill demolition landfill is a land disposal facility which meets <br />the following criteria: <br /> <br />A. Fill material is limited to clean concrete, concrete block, brick, or similar inert <br /> material acceptable to the Department. <br /> <br />B. The site location is in a Iow demity population area with less than I00 dwellings <br /> within 1,320 feet of the site. <br /> <br />The facility is not open to the public, the source of the fill material is <br />specifically identified in the application~ and the facility operator contracts <br />directly with the source of the fill material. <br /> <br />D. Adequate site security is available to control site usage. <br /> <br />SECTION IX. 5t:~CIAL WASTES. <br /> <br />Subsection I. Tires. <br /> <br />NO person shall cause or permit the management, storage, collection, <br />tranqx>rtation, processing or disposal of waste tires, except in full compliance <br />with the provisions of this ordinance. For the purpose of this subsection, a <br />trc~sporter of waste tires sh~ll be co~sidered to be the ogent of a person who <br />produces or otherwise accumulates waste tires in the course of his business. <br /> <br />The land storage or Ica~cl disposal of waste tires is prohibited unless said waste <br />tires are first processed to a maximum particle size of six (6) square ino~es on <br />ony surface. This section s~ll not preclude the storage of waste tires at <br />collection canters licensed by the county ar on-site storage by persor~s who <br />produce or otherwise generate waste tires. <br /> <br />-15- <br /> <br /> <br />
