The parties agree that the County will secure all necessary permits for this Project. The City agrees to <br />coordinate with the County in securing the permits required by the Lower Rum River Watershed <br />Management Organization. <br />II. METHOD: <br />The County shall cause the construction of the Project in conformance with said plans and <br />specifications. The County shall do the calling for all bids and the acceptance of all bid proposals. <br />III. COSTS: <br />A. The contract costs of the work, or if the work is not contracted, the cost of all labor, <br />materials, normal engineering costs and equipment rental required to complete the work, shall constitute <br />the actual "construction costs" and shall be so referred to herein. "Estimated costs" are good faith <br />projections of the costs, which will be incurred for this project. Actual costs may vary and those will be <br />the costs for which the relevant parties will be responsible. <br />B. The estimated construction cost of the project (including County furnished materials) is <br />$26,500,000. The total project costs are estimated at $49,000,688. Participation in the construction cost <br />is as follows: <br />Per the current Joint Power Agreement between the County and the City, Anoka County Contract No. <br />2005-0516, also known as the Ramsey Town Center Agreement, the City has some responsibility for the <br />cost of CSAH 83 north of the BNSF railroad right of way as well as the local city street connection <br />south of TH 10. <br />Both parties agree to share equally in any local costs to include, but not limited to, both preliminary and <br />final design, land acquisition expenses, environmental, building demolition, property appraisals, and <br />construction. Per the attached project funding exhibit, it is anticipated that both the County and the City <br />will each participate up to $2,807,744. Please note that both the County and the City have previously <br />realized costs that are to be included in the aforementioned estimate. <br />Upon award of the construction contract, both the County and City shall provide their respective local <br />costs for the project. The agencies shall determine if any equalization shall occur at that time. <br />Following the completion of the project including all property acquisition, both agencies shall provide <br />actual project costs, determine any payments that may need to occur and bill the other agency <br />accordingly. <br />IV. TERM <br />This Agreement shall continue until terminated as provided hereinafter. <br />V. DISBURSEMENT OF FUNDS <br />All funds disbursed by the County or City pursuant to this Agreement shall be disbursed by each entity <br />pursuant to the method provided by law. <br />VI. CONTRACTS AND PURCHASES <br />All contracts let and purchases made pursuant to this Agreement shall be made by the County in <br />conformance to the State laws. <br />
