That part of the Northeast Quarter of the Southwest Quarter of Section 28, Township <br />32, Range 25, Anoka County, Minnesota, described as follows: <br /> <br />Beginning at the point of intersection of the west line of said Northeast Quarter of <br />the Southwest Quarter with the southerly right of way line of the Burlington <br />Northern Railroad; thence southerly along said west line of said Northeast Quarter of <br />the Southwest Quarter to its intersection with the northerly right of way line of U.S. <br />Highway No. 10; thence southeasterly along said northerly right of way line of said <br />U.S. Trunk Highway No. 10 a distance of 485.00 feet to the actual point of <br />beginning of the tract to be herein described; thence continuing along the northerly <br />right of way of said highway a distance of 140 feet; thence northerly to a point on <br />said southerly right of way line of said Burlington Northern Railroad distant 691.80 <br />feet southeasterly from the west line of the Northeast Quarter of the Southwest <br />Quarter as measured along the southerly right of way of the Burlington Northern <br />Railroad; thence northwesterly along said southerly right of way line of said <br />Burlington Northern Railroad a distance of 140 feet; thence southwesterly to the <br />point of beginning. <br /> (the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />l) <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the Ramsey City Code on February 5, 2004 and that the <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated by reference. <br /> <br />2) <br /> <br />That the Subject Property is approximately 2.0 acres in size and is zoned B-2 Highway <br />Business; the surrounding parcels are zoned B-2 Highway and E-2 Employment. <br /> <br />3) <br /> <br />That Section 9.20.22 (B-2 Highway Business) of the Ramsey City Code states that motor <br />vehicle sales is a permitted use and all vehicle display areas, as well as <br />customer/employee parking areas, must be surfaced with bituminous or concrete and the <br />perimeter of said pavement must be finished with B6/12 concrete curbing. <br /> <br />4) <br /> <br />That on December 22, 2003, the Applicants submitted a request for an Interim Use Permit <br />to store and display auto and recreational vehicles on the Subject Property on an area that <br />is absent of the required pavement and grading improvements due to weather conditions <br />not being conducive to installing the requirement improvements. <br /> <br />5) <br /> <br />That the Applicants have stated they will be installing the required holding ponds, <br />bituminous pavement, and concrete curbing in the Spring of 2004 when the weather <br />conditions permit the installation of such improvements. <br /> <br />6) <br /> <br />That the Applicants will be required to submit a grading and paving plan that is subject to <br />the City Engineers approval prior to initiation of any paving and grading improvements <br />on the Subject Property. <br /> <br />7) <br /> <br />That the proposed improvements shall conform to the performance standards established <br />in the B-2 Highway Business District. <br /> <br />RESOLUTION #04-02-056 <br /> Page 2 of 4 <br /> <br /> <br />
