Meeting with property owners abutting Trappers Ridge subdivision. <br />Steve and Christy Dusbabek <br /> Francis and Lorri Kaas <br /> February 25, 2004 <br /> <br />Outstanding Questions: <br /> <br />1) Are the property owners willing to allow for access? If so, what type of access <br /> (i.e. private easement for Bauer, City fight-of-way that may potentially be a fully <br /> improved City. road? <br />2) Is the City interested in pursuing the purchase of the easement for access to the <br /> west? If so, who would purchase it (Bauer, City)? .~ <br />3) If there is no desire from. the property owners to allow fOr any access, how does <br /> the City rectify the situation of the trees being removed? <br /> <br />Options: <br /> <br />1) <br /> <br />2) <br /> <br />City does not buy land for the right-of-way of 160th Lane. <br /> a) Bauer negotiates a private easement for access to his property. <br /> b) If property owners are not interested in allowing access, Bauer will need <br />to find an alternative access from Olivine Street NW/161st Lane. City and <br />the property owners will need to reach a settlement regarding the removal <br />of the trees on their property. <br />City enters into negotiations with property owners to purchase land for 160th <br />Lane right-of-way. <br /> a) The City, and property owners would enter into negotiations for the sale <br /> and conduct a real estate transaction to transfer the property. Property <br /> owners would be compensated from the purchase of the easement. <br /> b) If the City determines that it is in the best interest to purchase the <br /> easement and the property owners are not interested in providing access or <br /> the two parties are unable to reach a negotiated purchase, the City could <br /> acquire the land through the eminent domain process if the City Council <br /> determines that eminent domain should be used. <br /> <br />Next Steps: <br /> <br />1) <br /> <br />2) <br /> <br />3) <br /> <br />Determine the desires of the property owners in regards to allowing for <br />access. <br />Schedule a City Council work session in March to discuss the matter and get <br />some direction from the City Council on how to proceed. This discussion will <br />involve the property owners and Bauer and allow for every party to have input <br />in the process. <br />Depending on what final decision is, initiate the appropriate steps to <br />implement the action. <br /> <br /> <br />
