Case #2: Request For Conditional Use Permit; Case of Group W Cable: <br /> (Continued} <br /> <br />Councilmember Van Wagner inquired if Mr. Voigt's Outlot A was being <br />reconsidered. <br /> <br />Mayor Gamec replied that technically, Group W withdrew the application. <br /> <br />Councilmember Van Wagner replied that the residents of Rolling Green were <br />informed that the final decision had not been made, that the tower could <br />still be located on Mr. Voigt's property. <br /> <br />Mayor Gamec replied that was the case until Group W withdrew the application. <br />He further stated that Mr. Voigt was not involved, he was only the landowner <br />and the same applies to Mr. Morris, the request for a conditional use permit <br />is from Group W. <br /> <br />Councilmember Schlueter stated that not making a ruling on Outlot A does not <br />seem like justifiable treatment. <br /> <br />Terry O'Connel stated that if the request to locate on Mr. Morris' property <br />is denied, Group W would submit a request for Outlot A again, but it doesn't <br />seem very practical. <br /> <br />Councilmember Van Wagner replied that Council's intent was to have Group W <br />search out more suitable sites, not withdraw their application for Outlot A. <br /> <br />Terry O'Connel stated that Group W withdrew application for Outlot A because <br />no mention was made of it at the P & Z public hearing held on February 15, <br />1983 and P & Z recommended that Council approve of locating the tower on <br />Mr. Morris' property. <br /> <br />Art Raudio - Inquired if Group W withdrew their application under duress, <br />because Mr. Voigt still wants the tower located on his property. <br /> <br />Mayor Gamec stated that the problem is with City Council, that the Council <br />has to make a decision that some people are not going to like. <br /> <br />Terry O'Connell stated that the City Building Official contacted him and <br />requested a withdrawal of application regarding Outlot A in order that the <br />Morris property could be discussed. He also stated that the P & Z public <br />hearing held on February 15, 1983 went very well and both sites are suitable <br />to the T.V. tower. <br /> <br />Mr. Berglund inquired if Group W would be willing to withdraw their application <br />for withdrawal. <br /> <br />Terry O'Connell replied that they would if Council wanted that option, but <br />that both sites are suitable. <br /> <br />Mayor Gamec stated that the location to be discussed tonight is the Morris <br />property. <br /> <br />Mr. Berglund stated that Outlot A was tabled and when was a decision going <br />to be made regarding Outlot A? It is my understanding that Outlot A was <br />never out-the-door, that Council requested another site to compare to. <br /> <br />C/February 22, 1983 <br />Page ll of 21 <br /> <br /> <br />
