City Attorney Goodrich replied that legally, the City is hard pressed to <br />rescind a conditional use permit and that the City was required to make <br />"a reasonable attempt" to notify all persons within 350', which the City <br />did do. <br /> <br />Rita Hoeschen requested proof that the City is required to make only "a <br />reasonable attempt", that her attorney informed her that the City of Ramsey <br />does not have a leg to stand on in this case, and inquired if Ramsey is <br />above the law, and requested another public hearing be conducted. <br /> <br />No action was taken by Council. <br /> <br />Rita Hoeschen - Stated that earlier this evening, discussions in Citizen <br />Input focused on better communication and Council's handling of the <br />conditional use permit for Quad Cities is not good communication. Mrs. <br />Hoeschen requested Council's decision regarding fencing around the T.V. <br />tower and accessory building. <br /> <br />Mayor Gamec stated that in his motion of February 22, 1983 approving the <br />conditional use permit, he intended for fencing around the tower and <br />accessory building only, and not the guy wires. <br /> <br />Discussion ensued regarding the possibility of reqUiring'fencing around guy <br />wires also. <br /> <br />Darryl Fults stated that Mr. Cliff Morris and Group W would be meeting on <br />March 23, 1983 for ~he purpose of entering into a rental agreement and that <br />they should be notified as to how much fencing is going to be required <br />because it could make a difference regarding that agreement. <br /> <br />Mayor Gamec polled the Council for their opinions regarding fencing. <br /> <br />Councilmember Schlueter had no comment based on the fact that she abstained <br />from voting on the resolution adopted February 22, 1983. <br /> <br />Councilmember Reimann stated that he feels tower and guy wires should be fenced. <br /> <br />Councilmember Van Wagner stated that she is not in favor of fencing in the <br />entire acreage, that fencing should be around tower and building only. <br /> <br />Councilmember Sorteberg stated that he is in favor of fencing in the guy <br />wires in addition to the tower and building. <br /> <br />Mayor Gamec requested an opinion from Councilmember Schlueter. <br /> <br />Councilmember Schlueter stated that she would be in favor of fencing in <br />tower, building and guy wires. <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember Sorteberg to <br />adopt Resolution #83-25 to amend Resolution #83-10, Paragraph 2h to read as <br />follows: That the structure, tower and guy wires on the site be surrounded <br />by an 8' fence. (Please refer to resolution file for Resolution #83-25). <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, <br />Van Wagner. Voting No: None.
