property; <br /> <br />- make no assessment for initial construction <br /> of the MSA street, however, there could be <br /> an assessment in the future for overlay or <br /> sealcoating; <br /> <br />- allow the landowner to retain any excess <br /> earth material after construction; <br /> <br />-make no assessment to those properties for <br /> street lighting along that MSA street in <br /> the event the City chooses to light that <br /> street in the future; <br /> <br />- allow the landowner two private residential <br /> accesses onto Front Street to the south and <br /> and three commercial accesses onto Front <br /> Street to the north and a street intersecting <br /> Front Street to the south for a residential <br /> development; <br /> <br />- install and provide a storm sewer system <br /> consisting of a single line serving Front <br /> Street and the owner's property; <br /> <br />- provide and construct three commercial sewer <br /> and water services and three residential <br /> sewer and water services and one in-street <br /> sewer service and two in-street water mains <br /> from the trunk, which is a lateral in this <br /> instance. (Landowner will designate <br /> locations of those services.). <br /> <br />Mr. Goodrich noted that the City will not provide sewer and water utilities <br />to these properties at no charge. At the time connection is made to the <br />trunk, the landowner will pay the current availability charge and any <br />lateral utility benefits. The balance of the document addresses the <br />abstract and makes sure the title is marketable; the City will undertake to <br />draft necessary deeds and other legal matters related to the Front Street <br />Sewer and Water Project. <br /> <br />Mr. Goodrich stated that the basic difference between the proposed Holasek/ <br />Hamilton agreement and the Elofson agreement is that the for the Elofsons, <br />the City would actually construct physical driveway acceses to the north <br />commercial property and to the south residential property. <br /> <br />Mr. Goodrich stated that all these terms contained in the proposed <br />agreements were agreed to by the Council and the property owners at the <br />December 22, 1987 City Council meeting. <br /> <br />Mr. Hartley stated that he received a telephone call from Winslow Holasek <br />insisting that all of the agreements must be identical.
