of thing that can likely be construed as adding cost to or being an adverse <br />effect on vertical expansion. <br /> <br />Councilmsmber Pearson - Inquired as to who makes the final determination as <br />to whether the landfill can be used for a ski hill and how soon that <br />determination will be made. <br /> <br />Mr. Hartley replied that the Metro Council, Anoka County and PCA are the 3 <br />major agencies that determine whether or not the landfill can be used for a <br />ski hill. Those most active agency is PCA because the area being talked <br />about for a ski hill is under PCA's jurisdiction in a Consent Order. PCA <br />will probably request comments and advice from Anoka County and Metro <br />Council. Mr. Hartley inquired that if asked, how should Ramsey respond to <br />one of these 3 agency's requests for comments. If Ramsey did have a <br />comment that was negative to vertical expansion or development of a ski <br />hill, that would be a condition of default of the agreement. <br /> <br />Councilmember DeLuca - Stated that the city's primary goal is to make sure <br />remedial action takes place and that the health and welfare of the city is <br />maintained and established with respect to pollution that is there. Stated <br />concern that the agreement would take away the city's right for input on <br />remedial action and possibly make the city liable for punitive damages. <br />Another issue of concern is the concept of cooperation. Possibly, there <br />should be some sort of framework where there would be periodic reviews to <br />make sure everything is going smoothly between the City and Waste <br />Management. <br /> <br />Mayor Reimann - Stated that it is very important for the City to have input <br />regarding remedial action. Mayor Reimann disagreed with the idea of <br />develo~ent of a ski hill being used to entice the City into taking a <br />favorable stance on vertical expansion. Mayor Reimann stated that 5 years <br />after closure se~ms like a long time to wait for a ski hill. Mayor Reim~nn <br />disagreed with tying all of the existing landfill property into the <br />agreement because it creates too many ways for the City to default, <br />including ways that are not under the City's control. Development of a <br />recreational area would be a positive step but there are too many <br />conditions tied into the agreement the way it is written that would put <br />Ramsey on the short end. <br /> <br />Councilmsmber Arnie COx - Confirmed Ms. Steffen's comments regarding County <br />and City concern regarding litigation and mitigation to host communities. <br />Councilmember Cox stated that the landfill was here before Ramsey became a <br />City and was imposed on Ramsey by the State. Waste Management took over <br />the operation of it in about 1971. Up until that time, Anoka was using it <br />as a dumping ground for leachate from their treatment plant. People <br />adjacent to the landfill are concerned about problems arising because of <br />that facility. When interest in vertical expansion was expressed, the City <br />hoped there would be some way to make expansion acceptable rather than a <br />totally adverse problem. Councilmember Cox stated that everytime contracts <br />and extensions are discussed, noting that in those discussions he has never <br />heard anybody claim it would be for a certain time frame, Ramsey ends up on <br />the short end.
