10 Minutes CASE #3: <br /> <br />REQUEST FOR CONDITIONAL USE PERMIT TO OPERATE <br />AUTOMOBILE SALES BUSINESS IN I-1 INDUSTRIAL DISTRICT; <br /> CASE OF MR. STEVE SIMONS <br /> By: Anne Norris, Community Development Director <br /> <br />Background: <br /> <br />Mr. Steve Simons is requesting a conditional use permit to operate an automobile <br />sales business in the I-1 Industrial District at 7205-7210 Highway #10 NW. The <br />property is approximately 1.45 acres in size and has two residential structures <br />on it. The property is located on the northwest corner of Highway ~10 NW and <br />Ramsey Blvd. NW and there is access to the property from both thoroughfares. <br />Mr. Simons stated that he will continue to rent out the residential structures <br />for residential use and sell automobiles from the property in front of these <br />structures. <br /> <br />For your information, Mr. Simons presently owns and operates other automobile <br />sales businesses at 2535 Ferry Street North and 7445 Highway #10 <br /> <br />Enclosed are the following items for your information: <br /> <br />a) Application <br />b) Site location map <br />c) Public hearing notice <br />d) Properties notified <br />e) Proposed site plan <br />f) Proposed findings of fact <br />g) Proposed conditional use permit agreement <br /> <br />Photographs of Mr. Simons' properties will be available at the meeting. <br /> <br />Observations: <br /> <br />The Planning and Zoning Commission conducted a public hearing on Mr. Simons' <br />request on November 5, 1986. The Commission recommended that Mr. Simons' <br />request be denied, as they were concerned about the impact of the sales on the <br />residential uses on that property. In addition, the Commission expressed <br />concern regarding access from Highway #10 NW and the use of the front yard for <br />Mr. Simons' sales area. The City Code states that off-street parking is not <br />considered an encroachment in the required front yard area. The Commission <br />noted that it would consider recommending approval of Mr. Simons' request if <br />the access from Highway #10 NW were removed and if Mr. Simons could park his <br />vehicles that are for sale behind the required front yard setback. <br /> <br />Recommendation: <br /> <br />Council Action: <br /> <br />Motion to: <br />Adopt Findings of Fact 00 .. relating to a request by Mr. Steve Simons for <br />a conditional use permit to operate an automobile sales business in the <br />I-1 Industrial District. <br /> <br />-and- <br /> <br /> <br />
