Minutes CASE #6:

REQUEST TO DELETE STREET ASSESSMENT;
CASE OF MR. GEORGE ADAMS
By: Pete Raatikka, City En§ineer

Background:

On April 22, 1986 Mr. George Adams filed a request to combine two lots south of
177th Avenue NW and adjacent to C.S.A.H. ~/7. The reason for combining the lots
was because one lot is totally in the flood plain and would be very costly or
possibly unfeasible to build on. This combination was approved by the County.
Therefore, at the time of the sealcoating assessment hearing we assessed the
Adams' property for one unit. In 1980, at the time of paving the streets, the
Adams' property consisted of two separate lots and was assessed accordingly.
At this time Mr. Adams is requesting that the City delete the remainder of the
assessment from the unbuildable lot.

Recommendat ion:

The combination of the two lots should have been made at the time of paving.
At that time the City could have spread the assessment over the entire project.
At this time the City would have to pay the assessment out of general funds.
Therefore, City Staff recommends against deleting the assessment.

Council Action:

Motion to:
Deny the request of Mr. George Adams for deleting the remainder of one
street assessment on two combined lots.

Review Checklist:

Administrator
Attorney
Engineer
Community Development Director

Chief of Police
Finance Officer
Public Works Superintendent
Other
