5 Minutes CASE #7: <br /> <br />CONSIDER DEFERMENT OF SPECIAL ASSESSMENTS FOR <br />SENIOR CITIZENS AND TOTAL DISABILITY HOMESTEAD <br /> By: Noel Graczyk, Finance Officer <br /> <br />Background: <br /> <br />The City Council may choose to defer the assessments outstanding against a <br />property owner in accordance with City Ordinance #83-14. <br /> <br />The ordinance first states who may be considered for possible deferment° A <br />person 65 years of age or older or a person who is retired by virtue of a <br />permanent and total disability, substantiated by a sworn affidavit from two <br />different licensed medical doctors may be considered for a possible deferment. <br /> <br />If a resident qualifies for consideration of a deferment, then the ordinance <br />states that the assessment may be deferred if a hardship exists. A hardship <br />exists if the annual gross income of the individual including non-taxable <br />income, does not exceed $12,000 and the assessment to be deferred exceeds <br />$300. The Council may consider exceptional and unusual circumstances pertaining <br />to an applicant not covered by the above standards for determining the existance <br />of a hardship. <br /> <br />On September 7, 1986, two requests for deferments were reviewed by the Council. <br />The deferments were denied on the grounds that the initial applications were <br />not received prior to the final adoption of the assessment roll in accordance <br />with Ordinance #83-14. Review of the public notice by the City Attorney <br />indicates that the denial should not be based solely on the grounds that the <br />application was not received prior to final adoption of the assessment roll. <br />For this reason, the two requests considered by the Council will be presented <br />for further consideration in addition to a third request received regarding a <br />total and permanent disability. <br /> <br />Enclosed for your information are the three applications we have received. <br /> <br />Recommendation: <br /> <br />Council should consider individually each of the requests from the following <br />applicants: <br /> <br />Melvin F. Jelinek <br />Bernhard G. Riewe <br />Carla C. Kruse <br /> <br />At the present time the applicants are still submitting materials in support of <br />their requests.
