to do what they disliked so much when Council was doint it. <br /> <br />Commissioner Gamec noted that many people that voted on the charter don't <br />really know and understand the charter; this Commission has the knowledge on <br />which to base changes and go through with those changes. <br /> <br />Commissioner Buchanan replied that the one nice thing about the syste~ is that <br />even if you don't know anything, you're allowed to vote. Commissioner <br />Buchanan added that he would probably vote for the amendment in a city wide <br />election but would not vote for the amendment if it comes from the Charter <br />Commission alone. The proposed change is broad and sweeping and should not be <br />made by. a Commission of 9. <br /> <br />Motion by Commissioner Lichter and seconded by Commissioner Gamec to include <br />on the Nov~nber election ballot an amendment to the Charter as follows: <br /> <br />Section 8.07. When a proposed improvm~ment is petitioned for by 100% <br />of the benefitted property owners, Council may waive procedures defined <br />in Section 8.05 of this charter. However, the public hearing on the <br />improvement must be held, but only a 10 day notice is required after <br />publication in the City's official news~per. <br /> <br />Further Discussion: Commissioner Gamec noted that there is no city election <br />scheduled for Nov~ber, 1985. Chairman Sieber suggested obtaining public <br />input to the matter by inserting an informal ballot in the city newsletter. <br /> <br />Commissioner Lichter withdrew his motion and Commissioner Gamec withdrew his <br />second to the motion. <br /> <br />Motion by Commissioner Buchanan and seconded by Chairman Sieber, for <br />discussion, that in the next city newsletter the proposed charter amendment be <br />explained and request the citizen response in the form of a survey card, if <br />feasible, and if not, in the form of a public hearing. The decision making <br />process will continue from there. <br /> <br />Further Discussion: Chairman Sieber stated that a recommendation for the <br />amendment could be sukmitted to Council with the stipulation that if Council <br />adouts the amendment, the amendment will not take affect for 30 days after <br />it's publication in the newsletter. Commissioner Buchanan stated that <br />Chairman Sieber's suggestion is the same attitude that initiated the charter; <br />make a change and if the people don't like, try and stop it. <br /> <br />Motion failed. Voting Yes: Chairman Sieber and Commissioner Buchanan. <br />Voting No: Commissioners Gamec, Lichter and Greenberg. Abstain: <br />Commissioner Bauerkemper. Absent: Commissioners Heitman, Titterud and Data. <br /> <br />Motion by Commissioner Gamec and seconded by Commissioner Buchanan that <br />developers be approached, through Mr. Lyle McLaughlin and Mr. Art Raudio, to <br />sukmit to Chairman Sieber their recommended language for amending the <br />charter with respect to 100% petitioned for and assessed projects.
