The Commission proceeded to review Chapter 8, section by section, for the <br />purpose of making any necessary revisions. <br /> <br />Section 8.01. Power To Make Improvements And Levy Assessments.~ <br /> <br />No change. <br /> <br />Section 8.02. Effective Charter Provisions. <br /> <br />No change. <br /> <br />Section 8.02. Local Improvement Ordinances and Regulations, <br /> <br />No change. <br /> <br />Section 8.04. Definitions and Procedures. (.Title Change) <br /> <br />Section 8.04.01. Definitions. <br /> <br />(?his is a new section that was added prior <br />to 8.04.01 Procedures, which will now <br />change the numerical sequence of this 8.04) <br /> <br />a) <br /> <br />Abutting Property Owners - This phrase refers to the owners of real <br />property in the City of Ramsey, which parcels abut upon a proposed local <br />improvement and benefit from the improvement. <br /> <br />b) <br /> <br />Non-Abutting Property Owners ~ This phrase refers to the owners of any <br />real property in the City of Ramsey which does not abut, but which may <br />receive a benefit from a specific local improvement, <br /> <br />c) <br /> <br />Property Owner ~ Refers collectively to the individual, individuals, <br />entity or entities noted as the fee owner, or in the case of land being <br />purchased under contract for deed, to the vendee thereof, according to <br />the then current records of the Anoka County Auditor, of each. parcel of <br />land which is recognized as a separate tax parcel by the Anoka County <br />Auditor. <br /> <br />d) <br /> <br />Benefit - Refers to an actual increase in the fair market value of a <br />parcel of realty as the result of a local improvement, Ail benefited <br />property shall be defined before the public hearing on the improvement <br />is conducted. <br /> <br />e) <br /> <br />Local Improvement - Refers to any impmovement to any publicly owned <br />facility, including but not limited to streets., alleys, sidewalks, <br />sanitary sewer lines, city water services~ storm sewers, drainage <br />facilities, street lighting, utilities, parks, buildings or other public <br />property, which improvement is carried out, in whole or im part, under <br />the authority of the City of Ramsey. <br /> <br />f) Benefited[. Property Owners - Includes both abutting and non-abutting <br /> property owners who benefit from an improvement. <br /> <br />Section 8.04.02. Procedures.(Formerly 8.04.01 of the most recent charter draft.) <br /> <br />Ail improvements to be paid for by special assessments against the benefited <br />property shall be instituted by either, (1) the petition of at least thirty- <br />five percent in numberof the abutting property owners together with a <br />resolution adopted by an affirmative vote of the majority of all of the council <br /> <br />CC/January 26, 1984 <br /> Page 5 of 8 <br /> <br /> <br />
