Commissioner Data - Inquired if there would be a summary of the City's policy <br />available for Commission review. <br /> <br />Audience Comment - There are various policies and they could be incorporated <br />into the charter. <br /> <br />Commissioner Data - Yes, provided they are not too specific. <br /> <br />Audience Comment - Referring to Section 6.04 -- competitive bids are required <br />and awarded to lowest responsible bidder. The lowest bidder is not always the <br />most responsible. You should state that the City reserves the right to reject <br />any and all bids. <br /> <br />Mr. Dorn- This section also notes that the City will follow the Uniform <br />Contracting Law and that law states that the City has the right to reject <br />any and all bids. <br /> <br />Audience Comment - Chapter 6 appoints all duties as the responsibility of the <br />City Administrator. Can that person transfer duties? Charter says he can't. <br /> <br />Commissioner Sieber - The City Administrator has the ultimate authority to <br />see that a task is done. He can delegate jobs, but if it is done wrong, <br />he is responsible. <br /> <br />Audience Comment - Major functions of the City are done by other than the <br />City Administrator. <br /> <br />Commissioner Sieber stated that he would be willing to change the wording <br />from 'power' to 'authority' or 'responsibility'. <br /> <br />Audience Comment - The charter does not even touch on finance or assessing <br />departments. <br /> <br />Commissioner Bauerkemper - Our intent is to keep the charter simple. A <br />department that may be appropriate at this time may not be in the future. <br /> <br />Audience Comment - If the charter stated that the City will have a police <br />department, after it's adoption the City is mandated to have that department. <br /> <br />Audience Comment - The way the charter reads now, 3 councilpersons could <br />eliminate all departments except City Administration. <br /> <br />Commissioner Bauerkemper - Even if Council eliminated a necessary department, <br />the people could bring it to initiative and referendum. <br /> <br />Commissioner Data -'Council may by ordinance establish city offices'. If Council <br />abolishes a necessary department, they will be subjecting themselves to recall. <br />There would then be a petition to get that ordinance re-enacted. That ordinance <br />would be binding. <br /> <br />Chairman Heitman - Such an ordinance would be considered an emergency ordinance <br />and take effect immediately. <br /> <br />Mr. Dorn- In 1973, City Council of Ham Lake abolished their Police Department. <br />That issue is still in litigation.
